Indiana’s attorney general, Todd Rokita, told Fox News he intended to investigate Dr. Caitlin Bernard. He suggested she failed to file required reports after performing a 10-year-old’s abortion, an assertion that appears to be refuted by a state document.

A lawyer for the Indiana obstetrician who has drawn national attention for providing abortion care to a 10-year-old rape victim said on Thursday that the doctor had taken “every appropriate and proper action” in the case — including filing necessary forms to report the abortion with state authorities, contrary to the assertions of Indiana’s attorney general.

The case of the rape victim, who crossed state lines from Ohio to get an abortion in Indianapolis, has become a hot-button issue in the nation’s roiling abortion debate. Many on the right — including the Ohio attorney general — initially doubted the veracity of the story when it was shared by Dr. Caitlin Bernard, the Indiana obstetrician. The story was confirmed after the arrest of the man accused of raping the girl. Yet Dr. Bernard remained under scrutiny.

The Indiana attorney general, Todd Rokita, told Fox News on Wednesday that he intended to investigate Dr. Bernard, and suggested she failed to file required reports.

“We’re gathering the information, we’re gathering the evidence as we speak, and we’re going to fight this to the end, including looking at her licensure if she failed to report,” Mr. Rokita said in an interview, in which he assailed Dr. Bernard, who practices in Indianapolis, as an “abortion activist acting as a doctor, with a history of failing to report.”

But a document obtained by The New York Times appears to contradict Mr. Rokita’s assertion. The document, a “Terminated Pregnancy Report” filed with the Indiana Department of Health and the Department of Child Services, states that Dr. Bernard provided abortion medication — a two-pill combination that can be taken at home or in any location and is authorized for use in the first 10 weeks of pregnancy — to a 10-year-old patient on June 30. The report was dated July 2, which puts it within Indiana’s three-day reporting requirement.

everyone helping her is getting beat up.
I have some idea how "witches" felt a few hundred years ago. Why must we constantly find people to fear and hate. When I was a kid, it was red-baiting and Communists we feared, but we've been looking for good victims ever since.

Tell us anything about the truth of that, and the AG used weasel words regarding the specific incident of the 10-year-old.

I hope the doctor’s lawyer goes after Glenn Kessler and the WaPo as well. Even after the arrest was made, there was a small “update” but no retraction or reconsideration of the shoddy reporting that led to his bad story in the first place.

The AG added the smear that Dr. Bernard has “a history” of failing to report. Where is his evidence of that? NYT should have investigated and reported on that too.

My point is that the AG’s saying he was “investigating” whether she failed to report this specific incident may not be clearly defamatory. But saying she “has a history” of essentially breaking the law definitely is defamatory if it is not true. So I want to know if it’s true. It’s already been proven that she reported the recent incident.
