In a 112-page ruling, U.S. District Judge Amit Mehta said the evidence suggests Trump assembled the crowd and then instructed the rally goers to march on the Capitol, despite knowing that the crowd likely included violent and destructive elements.Trump assembled the crowd and then instructed the rally goers to march on the Capitol, despite knowing that the crowd likely included violent and destructive elements.
And Trumps Twitter attack amid the violence on then-Vice President Mike Pence, who was presiding over the counting of electoral votes that would finalize President Joe Bidens victory, suggests a tacit agreement with those who stormed the Capitol and sent Pence and lawmakers fleeing for safety, Mehta wrote.
It is reasonable to infer that the President would have understood the impact of his tweet, since he had told rally-goers earlier that, in effect, the Vice President was the last line of defense against a stolen election outcome, ruled Mehta, an appointee of President Barack Obama.

(7,839 posts)The First Amendment grants all citizens expansive protections in what they can say, but that protection must be particularly guarded when it comes to the President of the United States. As the Supreme Court has repeatedly reminded, a Presidents position in our system of government is unique and his duties and responsibilities are of unrivaled gravity and breadth. Vance, 140 S. Ct. at 2425. A President could not function effectively if there were a risk that routine speech might hale him into court. Only in the most extraordinary circumstances could a court not recognize that the First Amendment protects a Presidents speech. But the court believes this is that case. Even Presidents cannot avoid liability for speech that falls outside the expansive reach of the First Amendment. The court finds that in this one-of-a-kind case the First Amendment does not shield the President from liability.

tweets promoting the day. Be there, will be wild!
These suits will bankrupt Trump and ruin the rest of his life. Good.

On the subject at hand, lets space out the lawsuits to one every two weeks for maximum continued aggravation.
