Alex Jones could face perjury charges and up to 10 years in a Texas jail after his lawyer mistakenly

revealed text messages the InfoWars host claimed didn't exist, legal experts say

Alex Jones' legal prospects went from bad to very bad in court on Wednesday after his lawyer accidentally sent the entire contents of Jones' phone to opposing counsel, inadvertently revealing text messages that the InfoWars host had previously claimed didn't exist.

Jones is on trial in Texas after the parents of a boy killed in the Sandy Hook Elementary School mass shooting sued the conspiracy theorist for spreading falsehoods about the Newtown, Connecticut school shooting that left 20 children and six staff dead in December 2012.

Jones has already been found liable for defamation in the case and three other lawsuits in Texas and Connecticut for his depiction of the shooting. The civil trial is the first of three in which juries must determine how much Jones should pay the victims' families.

The digital copy of Jones' phone that was shared with lawyers for Sandy Hook parents included a text about the massacre that Jones previously claimed didn't exist, as well as financial information about InfoWars that Jones failed to turn over during deposition.

Still seems odd that they blindsided their client on the stand. The plaintiff's lawyer claimed in court yesterday that they reached out to defense to see if they wanted to claim privilege and they didn't. So they knew the defense had this information even if it was an accident.

… to give false testimony. This “mistake” may have been the lawyer covering his own ass. Jones lied. He’s been caught. There won’t be a mistrial, and he is likely to be sanctioned by the court. Perjury charges are less likely, but possible depending on how relevant his lies were to the issues in the trial.

It is a different thing when the client is a known liar ... the lawyer knows that, but he had no way of knowing Jones would lie on the stand. Tons of people who testify are liars. The difference with Jones is that he lies even though the evidence is right in front of him, and it helps the plaintiffs.

The job of the jury is to determine the truth.

Also, the lawyer may have told Jones what he did. It is strange he didn't ask for the phone information to be returned to him, *and* that Jones seemingly didn't know about it. I think Jones is a psychopath. He looked surprised, but he is an expert at faking emotions.

I watched some of Jones' testimony yesterday. His defense about the phone was that he has 5 phones with the same phone number. I guess he meant that was confusing, and they forgot about one of those same-numbered phones. So many phones and videos, so much paperwork ... the poor guy was overwhelmed with evidence to take care of. /sarcasm

Anyway, it seemed to me that the plaintiff's lawyer was really good at proving Jones was lying. I think he is doing a great job. I cannot imagine his glee when they received information from the phone.

Also the defense lawyer will probably be sued by Jones for malpractice, by Jones.

It is so hard to remember that this is a civil case when I watch the trial.

… Jones could bring against his lawyer for malpractice. Turning over records that have been requested is done in every case. If your client brings you records, and then takes the stand and denies the existence of the records, you have to act. You cannot just sit back and let him lie when you know it’s a lie. His lawyer could have objected to the production (I’m pretty sure he did), but if the judge overruled that objection, they have to be produced.

People do often lie under oath. But it’s not supposed to happen with the lawyers knowledge. The lawyer has to have at least some degree of plausible deniability. In this case he didn’t because, presumably, he’d seen the records and he then heard Jones’ testimony.

No client’s case is worth losing your license to practice law. Some lawyers will skate around such an issue when they can make a case that they didn’t know. This looks to be too obvious to deny.

But the lawyer’s defense of any claim made against him will be “I produced requested documents. My client’s lies are what got him in trouble”.

Jones should have never produced the records to his lawyer if he planned to lie about them. And the lawyer should have told him that if you lie, I’ll have to set the record straight and you’ll look bad.

There are dishonest lawyers out there. I know who they are in my local bar. So does everyone else - including the bench. They usually don’t get away with it for long because that kind of reputation catches up with you.

It's a civil trial about damages, so I don't think a mistrial applies here. But he can sue his lawyers for malpractice after the damages are awarded.

A lawyer cannot knowingly allow their client to commit perjury. Perhaps Jones' attorney left Jones out to dry. If so, it's terrific self-own and the lawyer likely covered his own ass.

Yes this is a civil case but is the defense allowed to lie and lawyers ignore obvious perjury? Seems like his lawyers should all be brought before the bar on ethics violations.

The judge mentioned he made 800k in one day, Jones fired back "that's not a normal day".
