Court rejects Democrat appeal to keep Green Party off ballot

RALEIGH, N.C. (AP) — A federal court denied Democrats’ last-ditch effort Thursday to keep the Green Party from potentially hurting their electoral prospects in North Carolina, rejecting their request to block a lower court order placing Green Party candidates on the November ballot.

The North Carolina Democratic Party and Democratic Senatorial Campaign Committee asked the 4th Circuit U.S. Court of Appeals to block an Aug. 5 district court order prohibiting the state elections board from enforcing a candidate filing deadline to keep the Green Party’s U.S. Senate candidate, Matthew Hoh, off the November ballot.

The court rejected the Democrats’ request for a stay in a one-page ruling Thursday, a day before the state board’s ballot printing deadline, without providing its reasoning.

The decision follows U.S. District Judge James Dever III’s order Wednesday denying the Democrats’ request that he block his own ruling in the Green Party case. Dever wrote that the Democratic organizations “clearly played a critical role” in delaying the Green Party’s ballot consideration and “do not appear in this court with clean hands.”

AND the REASON DEMs wanted to challenge the Green Party Candidate is that MANY of the signatures looked to be the same handwriting.

"There are numerous pages that have obvious signs of fraud or irregularities," she said. "These include the same handwriting throughout and similar signatures."

In the 2020 presidential and gubernatorial elections in North Carolina, the Green Party received less than 2% of the vote. That meant that the party needed a petition to be recognized in 2022.

For the petition, the Green Party needed the signatures of 13,865 voters. The party collected more than 22,000, and county elections boards certified nearly 16,000.

But those boards also told the state there were "irregularities" on the signature sheets.

Brinson Bell said she needed more time to investigate — even though a longer investigation means the Green Party could miss an August deadline for the state to prepare the ballot.

It bugs me. Democratic Party is a big part of our nation, as is The Republic and we each stand for certain things.

BUT I call them REICH Wing or Rethuglicans when they act that way.

Republican is used exclusively for people who are behaving in a manner befitting the standards they used to have. Like Liz Cheney not going to allow her party to force her to bow down to tRump.

JUST because, the rule is that you have a certain amount of VALID signatures to be put on the ballot and MANY fake signatures don't count, so are there more fakes that weren't caught? DOES NOT MEAN we are acting like DEMOCRATS vs following the Democratic Process where illegal voter registrations are a flag of possible unethical behavior needing investigation. Just like serving a valid warrant and following through isn't a raid.

Am I right?
