If a judge determines that they were taken from him illegally, he gets them back.


His record of petitioning the courts isn't exactly stellar. This could be due to a complete misunderstanding of the law.

Because taking them away from him was not illegal, nor a violation of his rights.

Keep in mind, he's the person claiming that DOJ acted improperly. If he really believes that he can petition for the return of the items that were taken.

That's not going to happen. If a court were to rule against him (and any court most certainly would) he'd have to quit his manufactured rage.

According to various reports TFG always regarded anything generated in the White House by or for him as his personal property and cared not at all if some were highly classified, since he also didn’t give a damn about national security or the IC, which he disliked and mistrusted. Even apart from the strong possibility that he wanted those documents for nefarious purposes, he wanted to keep them because he thought they were his, and he hates it when anybody tries to take his stuff. So of course he wants all that government property that he thinks is his own.

There’s a thing called the crime/fraud exception, which vitiates the privilege if the lawyer was involved in the commission of the client’s crime. In TFG’s case, and considering the sleaziness of his lawyers, there was probably a lot of non-privileged criming going on.

Important to remember that these constantly shifting excuses aren’t legal arguments and likely won’t look anything like a court defense. They’re talking points for Trump’s defenders to repeat endlessly on TV until he comes up with the next one.

company, he had to do business with the mob...He told me that they were not smart but that made them even more dangerous. He always said never let them do favors for them.

That's a way to show he thinks he was in the right by keeping the documents. If he doesn't ask for them back, he's admitting he was in the wrong in keeping them.
