Florida appeals court affirms an order prohibiting a parentless 16-year-old from terminating her pregnancy on the grounds that she has not proved she is mature enough to get an abortion. So the state will force her to have a child instead.
August 15, 2022
PER CURIAM.
Appellant, a minor, wishes to terminate her pregnancy. She
appeals the trial courts dismissal of her petition seeking judicial
waiver of the parental/legal guardian notice and consent
provisions under section 390.01114, Florida Statutes. The trial
court found, based on the nonadversarial presentation below, that
Appellant had not established by clear and convincing evidence
that she was sufficiently mature to decide whether to terminate
her pregnancy. Having reviewed the record, we affirm the trial
courts decision under the deferential standard of appellate review
set out in the governing statute. § 390.01114(6)(b)2., Fla. Stat.
(2022) (The reason for overturning a ruling on appeal must be
based on abuse of discretion by the court and may not be based on
the weight of the evidence presented to the circuit court since the
proceeding is a nonadversarial proceeding.). We note that section
390.01114 allows for a remand to the trial court with instructions
for a further ruling, but no such remand is warranted here. See id.
(An appellate court must rule within 7 days after receipt of
appeal, but a ruling may be remanded with further instruction for
2
a ruling within 3 business days after the remand.). The trial
courts order and findings are neither unclear nor lacking such that
a remand would be necessary for us to perform our review under
the statute.

Thanks for the inspiration.

I listened for years about how WI got what it voted for despite half the start being not Republican.

(28,819 posts)Despite having Tammy Baldwin and MarcPocan
I also will point out weve had the same fascist Republicans since 2009.
However, despite voter suppression by the State Republicans to aid in Statewide and National elections, WI still pulls blue.
Because we are fighting the good battle here.
But I sure have no problem with anyone pointing out how backward and hostile WI is.

(3,412 posts)Put it in the atrocious foster care system and perhaps imprison the mother for child neglect and/or abuse.
A satisfactory outcome for all of society. Two lives ruined.

(3,412 posts)I live here and I dont get it.
We are split pretty evenly between Dems and republicans. But ever since Jeb Bush, Republicans have won and gerrymandered the hell out of the State. They really fight dirty, use shady, if not downright illegal tactics to win elections.
Florida legislators ignore Constitutional amendments passed by the people and just do the hell whatever they want to do.
Until more people turn out in mass and vote them all out, I dont see anything changing.

(1,575 posts)My wife feels that is what will happen with the next election. I told her that I believe there are enough people, like in Kansas, that will come out and help the Dems keep the house and senate.

2. State makes her have the baby.
3. Child Protection practically in the Delivery Room and removes the newborn from 16 yo mother.
4. 16 yo's parental rights are terminated in court by Child Protection -- because she's too immature to raise a child.
5. Infant is adopted by fundamentalist Christian family.

(11,650 posts)Rs dont give a shit about babies after theyre born. The most likely scenario is that this poor baby will be born into extreme poverty and the mother will be forced to work instead of caring for her child. What cruelty.

The radicalized Republican party wants government-mandated birth. Women are not property and pregnancy does not justify indentured servitude to the state.
