NEW YORK -- The suspect in a violent unprovoked attack in the Bronx was released without bail Thursday.
Charges against 55-year-old Bui Van Phu were downgraded from attempted murder to assault and harassment.
Surveillance video shows Phu hit Jesus Cortes in the back of the head, knocking him to the ground on East 188th Street in Fordham.
The Bronx District Attorney says Cortes has a fractured skull and is currently in a coma.

(44,973 posts)If someone is out on parole (for rape), and then violently punches an innocent victim, shouldn't that parole be revoked?
Victim is in the hospital in a coma as far as I can tell.
And the attacker is walking free.

I see this locally, people don't understand that our justice system doesn't take assault very seriously as a crime.
We have a violent drunk in our neighborhood, and he's got a record a mile long. At the beginning of Summer he approached a woman with her little daughter in broad daylight at a little league game and asked her for money, when she refused he attacked her, punching her in the face. People chased him off, he then exposed himself to some children and resisted arrest. The Nextdoor chat about the incident revealed that people thought he as going away for years. I even got people to write the judge and prosecutors. He also was a convicted sex offender who was out of compliance with his registry. He did 75 days total in jail. People are just stunned, but I'm not, assault is just not a big deal in the courts. This woman was traumatized, her daughter is in therapy and refuses to go to parks anymore, it's an event that is going to effect their lives for years. But the Right Wing judge with a Right Wing prosecutor let this guy off with a slap on the wrist. He's already released and menacing the neighborhood.
Our system is out of whack. Violent crimes like assault need to come with serious consequences. The criminal code seems to care more about drug and property crimes. Someone who sucker punches someone like this is a grave danger to society, they need to be removed from our communities for a long time.

(19,066 posts)There are men that get in scores of bar fights in their lives and never do any real time over it. If it's like your 8th misdemeanor assault charge, that person needs to face years in prison.
I bounced at bars, at one we had a regular who would get arrested almost every week for fighting, and he'd rarely even spend a full night in jail over it. Was always just nothing more than a hassle for him, after like his 25th arrest he finally got 60 days in jail, most of his other sentences were a weekend in jail, or at most 10 days. Guy left a trail of black eyes, broken teeth, and broken jaws in his wake for decades and never faced any real consequences over it. And of course when you're fighting that much, you're really good at it and the people you're assaulting have no idea who they're up against.
One problem is that when people are assaulted, there's a shame associated with pressing charges. Few guys who lose a bar fight want to relive it in court. And even the violent drunk in my neighborhood has assaulted women and had them not press charges. There's a great deal of victim shaming that is engrained in our culture.
