This seems to be a weird flex, but former Donald Trump campaign attorney Joe diGenova assured us on Newsmax that the ex-president can run for office from prison. Greg Kelley and diGenova were talking about Rudy Giuliani's Georgia court appearance, which the former Trump attorney labeled as a "continuation of the show trials being conducted by the Democrats in Congress" even though there are two Republicans on the Jan. 6th committee. And the Georgia investigation is not from the J6 panel, although I'm sure they will be watching how it unfolds. It really is difficult trying to keep up with all of their crimes.

Kelly suggested that the prosecutors at the Justice Department are "corrupt" for doing their jobs after Trump withheld sensitive documents.

Of course, diGenova claimed that the legal search warrant executed on Trump's Florida resort, Mar-a-Lago, was politically motivated and will "live in infamy."

The subject of a possible indictment came up.

"Well, I just — sad to say, Merrick Garland is now crazy," diGenova insisted. "He is going to indict Donald Trump. They are going to figure out some charge because they want to harm him, to ruin him, to basically cut him off at the knees so he can't run for President."

"This is one of the most abusive attorney generals in history," he continued. "This process is arrogant, abusive, an affront to the Constitution. They are going to indict Donald Trump. Merrick Garland has lost his senses."

"But I think you pointed out last week if they do indict him, crazily enough, I mean, if they're crazy enough to do it, that doesn't render him ineligible to run or even be president," Kelly said.


Oddly, diGenova noted that Eugene Debs ran for President from prison in 1920, so no worries because Trump can, too.

"He — Listen, Eugene Debs ran for president from a federal prison," he said. "There's no reason that that's going to happen to Donald Trump. He's not going to be in a federal prison."

"But if he's indicted, he will run for president," he added.


"Wow," said Greg Kelly.

Wow, indeed. I assumed that Trump wants to run for office to avoid going to prison, so this is a different take.

...would be enforced. That would only apply if he were convicted in relation to the Jan 6 insurrection, of course.

That wasn't a factor in Debs case.

Folks seem to forget that anyone who fills out the form & pays the fee can run for POTUS. Last I checked more than 2,000 people usually do. High school kids run as a joke, even though they wouldn't meet the constitutional age requirement for holding the office.

So, running is one thing, meeting the constitutional requirements to hold the office is a separate matter.

1)Natural Born Citizen
2)Age 35
3)U.S. Resident for 14 years

Nothing says that residency cannot include time in prison.

So, he's in jail, wins the election, resigns, then the VP who is now President pardons him, then appoints Trump VP, then resigns. This could be done in a matter of hours.

Of course there needs to be a few things in place, such as a Senate that would allow Trump's appointment as VP.

Plus if convicted, the appeals will drag on for years.

Also zero chance he will be locked up and not released if he is simply indicted, so the OP makes no sense.

If they did lock him up with no bail, and tried to keep him there during the full trial, there would soon be violent, nationwide, non stop series of kinetic conflicts and terrorist attacks.

I sure as hell would not want be a 'stick out like a sore thumb' known Dem activist stuck in an ultra deep red area (especially in a deep red state) if that shit above hits the fan.

This would be to protect him from attack and to keep him from communicating secure information or disruptive rhetoric.

He might be able to sign up to run but active campaigning is out.

Running for office is not on the cards. NY and GA are close enough to indictment that no declaration would protect him. Both of those are state level trials which fall outside the federal mandate. If either state finds him guilty or adds a charge of witness intimidation or witness tampering he's toast. He cannot run for office inside state prison. Prisoners do not have rights to leave confinement to conduct such a campaign as TLG would require.

What needs to happen is for the GOP leadership to disengage with him. They've already seen how badly some of his endorsed candidates have fared. The party has already cut back on ad buys in 3 states and it looks as though more will be cut in the future. GOP fundraising is way off. TLG has never shared his funds with the GOP at large and is unlikely to do so now. Facing unthinkable legal fees and a future of unending court battles he's not going to spend on elections he's not part of. The Senate is all but lost to the GOP and even a flipped house cannot save him.
