Let's say TFG was still negotiating a sales price on any or all of the papers. And a fire broke out. And the papers were destroyed in the fire.

Even if the papers weren't traded, sold, etc., they would not have been preserved. Gone. Forever.

The fact of the matter is that the transgression is TFG took the papers to begin with, no matter what the outcome of their theft. They were supposed to be handed over and they weren't. And TFG intended to keep them indefinitely (or until a price was reached).

That is the least of his crimes.

The rest of it is icing on the cake; it doesn't matter what he intended to do with them or where he planned to keep them - he's guilty of the crime of taking them in the first place. If he also sold them or showed them to people or left them on a table at the Mierda-Loco breakfast buffet or wiped his ass with them (though he probably saves that chore for copies of the Constitution), that's just more criming to add to the underlying one.
