State Abortion Bans Face Obstacles as GOP Split
Many Republican-led state legislatures planned to move forward quickly with new abortion restrictions after the U.S. Supreme Court ended federal protections for the procedure. They are finding it more complicated than they anticipated.
In the weeks since the high court overruled Roe v. Wade, Republicans in a handful of states, including Indiana, West Virginia and Nebraska, have encountered disagreements within their own party about how far to push on abortion restrictions, as well as other stumbling blocks on the path to imposing new laws. Similar tensions are emerging among GOP lawmakers in South Carolina as they begin to debate just how far their proposed abortion bans should go.
Talking about being pro-life is very different than actually making laws and creating a public policy that will affect real peoples lives, said Elizabeth Bennion, a political-science professor at Indiana University South Bend.
About a dozen states have moved to enact abortion restrictions based on laws that predated the Supreme Courts Dobbs v. Jackson Womens Health Organization decision and were able to go into effect once the court overturned Roe. In the aftermath of the courts decision, Republican lawmakers looking to enact new abortion laws are facing challenges as they begin to see the real-life consequences of near-total banseven as the political will for new restrictions remains strong in many of these conservative states.
