Warning: any bill that has the unelected judiciary as the final arbiter of EV's is bad. Fiendish Thingy Aug 2022 #1

There was a “bipartisan” (Republicans and Gottheimer’s sabotage squad) proposal earlier this summer that inserted an unelected three judge panel, rather than the governor or congress itself, as the final arbiter over competing slates of electoral votes.

I think that is the worst of the various ideas being suggested.

Currently, the Electoral Count Act states that the governor, accountable to all the state’s voters (unlike the gerrymandered legislature) is the final authority in certifying a state’s slate of electors. The law states that only the slate certified by the governor is considered “duly appointed”.

That’s the way it should be, IMO.

There are certainly other improvements that could be made, but not the final authority over certifying electors.
