Trump wildly misses the point of notorious Mar-a-Lago picture

TFG is truly an idiot. First the complaints he has made about the evidence demonstration picture are all admissions against interest that will be used against him in court. Second, this FBI laid out the evidence collected as part of a normal chain of custody procedure that is used in all search warrant cases where significant evidence is collected. TFG is so stupid that he thinks that the FBI was trying to make TFG look messy when the FBI was merely treating TFG the same way that they treat a busted drug deal or other common criminal

https://www.msnbc.com/rachel-maddow-show/maddowblog/trump-wildly-misses-point-notorious-mar-lago-picture-rcna46093?cid=sm_npd_ms_tw_ma

Trump added, “People think that when you walk into my office, I have confidential documents or whatever it may be ― all declassified ― but I have confidential documents spread out all over my floor, like a slob, like I’m sitting there reading these documents all day long or somebody else would be.”

For the record, he didn’t appear to be kidding.

First, the idea that the materials were “all declassified” continues to be a claim so ridiculous that Trump’s own lawyers are afraid to raise it in court.

Second, as The New York Times reported, the way in which the FBI agents laid out the materials for the photograph was “in keeping with standard protocols for how federal agents handle evidence they come across in a search.”

Third, Trump has apparently moved on from the “planted evidence” talking point, choosing instead to seemingly confirm that these materials really were in his possession. In the process, he’s appears to have now contradicted — in writing and on the air — claims from his own lawyers about having previously returned all of the classified materials he’d previously taken.

Fourth, the clarification was wholly unnecessary: The Justice Department’s court filing doesn’t claim that the materials were found on the floor. Rather, it says the documents were “recovered from a container” in Trump’s office.

And finally, it doesn’t matter how they ended up on the floor. Trump has spent much of the week wildly missing the point of the entire scandal.

The point of the picture was not to show that TFG was messy but to document the chain of custody of the materials seized. TFG was being treated like a common drug dealer or common criminal. Such treatment is very appropriate

Again, TFG is a common criminal and the FBI treated TFG as a common criminal The fact that TFG is too stupid to understand this amuses me

TFG was being treated as a common criminal or drug dealer following a successful execution of a search warrant

TFG is a common criminal and was treated as such. The evidence of his crimes was documented by the FBI in accordance with standard procedures for dealing with common criminals

TFG is an idiot who is NOT listening to his attorneys. TFG has now repeatedly confessed to stealing top secret documents

https://www.msnbc.com/opinion/msnbc-opinion/will-trump-be-arrested-holding-top-secret-documents-n1298391?cid=sm_npd_ms_tw_ma

Former President Donald Trump’s response to the FBI's search of his Mar-a-Lago residence is paying off … for the Justice Department, not for him.....

So far, the only thing consistent about Trump’s defense strategy is that it is largely incoherent and legally irrelevant. Trump intimated that the FBI planted documents at his estate in Palm Beach, Florida. The problem with that, in addition to the fact that there is no basis for this claim, is that Trump has also argued that there is no problem with his having said documents not only because they are privileged but also because he declassified them. The National Archives and Records Administration rejected Trump’s previous privilege arguments, which were likely little more than an attempt to stonewall the investigation.

Trump’s pivot to arguing that he declassified the documents has two primary problems. First, there’s no proof that he actually did declassify the documents. Indeed, the letter from Trump’s attorney that was included as an exhibit in the partial release of the affidavit argues only that Trump had the power to declassify documents when he was president, not that he actually did so. Second, even if he did, none of the federal statutes cited in the search warrant depend on the documents’ being classified. Simply put, declassification isn’t a helpful defense for Trump.....

But two things are clear. The more Trump says, the worse this investigation is getting for him. And the more we learn, the more evidence we have that Trump isn’t a person who should ever be in a position of power again. Far from protecting and defending our country, all signs point to his putting it at serious risk.

Trump is exploiting the early assumptions of people who were not familiar with search procedures, but he is far from alone in thinking it was a photo of how the FBI found the documents.
