Question About Appealing Cannon's Ruling

Can DOJ only ask the 11th circuit to lift the stay she imposed? Lifting her stay would help mitigate this predicament.

If DOJ doesn't appeal, that means that judge Cannon is in charge of the case. No way an agreement on a Special master is reached on Friday. Then what, does she simply appoint someone? The FBI is limited from investigating the documents, like dusting for fingerprints on the nuclear documents.

My take on looking for executive privilege documents is based on Occam's Razor. If any document incriminates Trump in a crime, injures his reputation as the judge points out, then that document is considered executive privilege. The document can be returned to the Archives but it can't be used by DOJ to prosecute Trump.

This is my take on why a SM would look for executive privilege, according to Cannon.
