Can we arrest Dumbo as a material witness and bypass the Cannon fuckyou?

1. Hypothetically, yes.

18 U.S.C. § 3144, the material witness statute, says:

If it appears from an affidavit filed by a party that the testimony of a person is material in a criminal proceeding, and if it is shown that it may become impracticable to secure the presence of the person by subpoena, a judicial officer may order the arrest of the person and treat the person in accordance with the provisions of section 3142 of this title. No material witness may be detained because of inability to comply with any condition of release if the testimony of such witness can adequately be secured by deposition, and if further detention is not necessary to prevent a failure of justice. Release of a material witness may be delayed for a reasonable period of time until the deposition of the witness can be taken pursuant to the Federal Rules of Criminal Procedure.

I doubt it will happen, but if it did it sure would be fun to watch.

But I don't think it would take the threat of arrest for him to blame other people for his predicament because that's what he does anyhow. Realistically it won't happen, but it's amusing to contemplate.

although if he could blame them without incriminating himself he'd do it in a heartbeat. "I didn't pack those documents, Meadows took care of all of that. And the lawyers. And Jared. And the moving company. I never saw any of it. I didn't know they were there. It's a hoax."

Maybe Dumbo could spill on Meadows. SOMEBODY handed him dozens of boxes full of documents. And planned the whole caper. Dumbo no can think good.

I'm confident that the DOJ will handle this in the best way possible. This might include asking Cannon to alter her decision in areas where she definitely erred. That, I suspect, would be the first step before an appeal. Her "logic" is so weak in the ruling that I've yet to hear any expert on federal law say that it is anything other than pathetic.
