What happens if the MAL documents case is appealed to the Supreme Court?

If the Appeals Court rules in Trump's favor, not impossible I suppose, would the Supreme Court let the lower court decision stand?

Or would they make a ruling?

This would be one escape route they could take so that a former president would not have to be prosecuted, if they were so inclined.

I cannot see this case not going to the Supreme Court.

Clarence Thomas oversees the 11th Circuit where this case is decided. Oh Boy!

3. Thomas doesn't "oversee" the 11th circuit.

He is assigned to the 11th Circuit to handle emergency motions, such as a motion for a stay pending appeal, which he can either decide himself or refer to the entire court. And, if DOJ loses and seeks an emergency stay and Thomas denies it, DOJ then can go to any other Justice and resubmit the request.

He has no other role with respect to the 11th Circuit.

2. It's going to be interesting to watch how much public muscle the Federalist Society will flex

You and I know about them but a lot of people aren’t aware of them. Cannon is an actual child of the Federalists. I posted that Paul Huck Jr. seems to be the obvious preference for them. Others have countered that. We’ll see.

They filed in Cannon’s court not only relying on her loyalty but also because the path from there goes through the very conservative 11th (overseen by Clarance Thomas) and then the stacked activist Supreme Court.

So it is hard to say what may happen but it is possible they will rule rule against Trump again.
