Under the radar means nothing. He was appointed by Roberts to the FISA court.
All this talk about him being fair or right down the middle tells us nothing. Look at the types of people Roberts appointed to the SECRETIVE, NONPUBLIC FISC.
Theres a reason why trump put Dearie on the shortlist, we just dont know it. Maybe he is compromised in some way. Maybe he has a kid with ties to Russia. Maybe his connections in New York in the Giuliani era hold the secret. I recently heard that Giulianis prosecution of the Italian mob paved the way for the Russian mob. Dearies career trajectory intersected that era.
When the media starts telling us what to think about an unknown, get skeptical. They have a bridge to sell us.

(7,284 posts)It's been challenging for me to catch updates on a myriad of developments.
This one is long overdue, imo.

(21,379 posts)Trump finally has a sharp lawyer working for him, notice how he paid him 3 million up front. This new Trump lawyer is eating Garland's lunch.
Never in a million years would I believe that the FBI would be forbidden from doing forensics on top secret documents that involve our national security. Think about that and then tell me I am wrong. What about the rest of the documents that Trump still has? That will just be water over the dam.
Have the Cyber Ninjas produced the documents yet that a judge ordered them to produce? Just more water over the dam.
Magats play by different rules and no one stops them.

(92,325 posts)an unqualified judge to rule in his behalf, and your assumption that the DOJ is not going to appeal this I think is naive. They have to appeal it becuse it sets up an extremely dangerous precedent. You cannot have the documents marked as classified handled in this way.

(4,298 posts)DOJ should just take them back. See what happens later. We all know there is no enforcement of the law at the Executive and Congressional level...else Trump would be in jail now.
Carry on AG Garland, indict on some other charge and let this all play out.

(21,379 posts)Garland hasn't made up his mind yet whether it is proper to indict a former president.
Next month DOJ will be busy defending Trump (the office) against E. Jeanne Carroll, the woman he supposedly raped in a clothing store change room.

(42,737 posts)DOJ has the documents seized at Mar-a-Lago. Under Cannons order they are limited in how they can use them and have provide copies to Trumps lawyersthose two aspects of the order (among many) are problematic.

(92,325 posts)precedent, that I would find it very difficult to allow. Canon's decision has been viewed by the vast majority the legal community as extremely flawed, and that has come from both republicans and Democratic legal authorities, including those who were part of the trump administration.
It needs to be noted that when trump's legal team tried to overturn the the vote count in several critical swing states in the 2020 election, their legal arguments were ll soundly rejected, and this included judges who were appointed by trump.
The purpose of what trump's legal team is trying to do, is not to give trump possession of property that is not his to possess, but simply delay the process, as he has always done his worthless life.
As for Dearie's position about not being a friend, it is about being a neutral party, and there is no evidence to suggest otherwise.

(15,650 posts)This case will be appealed all the way to SCOTUS.
DOJ only accepted Dearie on the off chance Cannon would reverse herself and exclude the 100 classified documents. She didnt, so DOJ will appeal, first to the 11th circuit, then to SCOTUS.
