The thought that when the professionals at DoJ saw Judge Dearie on the shortlist they broke out the champagne and danced a little bit before putting their game faces back on and drolly said, "This man is acceptable."

I wonder if Kise is a mole in Bloated Tick's defense team.

I think they desperately wanted the second guy and thought DoJ would look at Dearie's name being first and think he was the unacceptable one. What DoJ actually thought was Dearie is a known factor, knows the law, fair, level headed. Not batshit. Definitely the acceptable one.
