Property Rights vs. Wetlands.
The thread of the Supreme Court case has been on Greatest Threads for a day, but I have only now had a chance to read it. Let me just say, Ketanji Brown Jackson is spot on, asking very relevant questions. Property rightest in Florida have been working to destroy wetlands in Florida since the eighties, so it's an issue I know well.
Let me start with, THESE LAND OWNERS KNOW WHERE THE WETLANDS ARE. Some even seek plats with huge swaths of wetland because they pick up the property on the cheap. They also don't have to pay taxes or pay lower taxes for the property. And then they wrangle for the right to develop the property later.
In fact, you can tell if they knew it was wetland if they paid a lower tax base for the property. And if there is a difference tax for wetlands vs undeveloped property, and if they paid the lower fee, it's prima facie that they knew.

(5,232 posts)see vacant land with a cow or two on it. We call them tax cows. I'm afraid if developers win this one, the beautiful Everglades near us will be bulldozed and built on as SW Florida cities need to move people away from the coastline for safety in future storms. We saw this beautiful region as safe from city sprawl, but that's up in the air now.
