Wisconsin group says Biden's student debt plan has 'improper racial motive'

This legal attack makes no sense. These assholes are upset that white people are getting less benefit compared to African Americans. In effect, white people are a protected class and no program can favor any other group. These assholes want to enshrine into law the concept that all programs must solely favor white persons.

A group in Wisconsin claims President Biden’s plan to cancel up to $20,000 in student loan debt violates federal law by intentionally seeking to narrow the racial wealth gap and help Black borrowers.

The allegation is among the claims in a lawsuit filed Tuesday by conservative legal outfit Wisconsin Institute for Law and Liberty on behalf of the Brown County Taxpayers Association. The complaint largely relies on arguments of executive overreach that have been raised in other legal actions to block Biden’s plan.

It stands out, however, by also bringing race into the mix.

In promoting the debt forgiveness plan, the White House has said it could help narrow the racial wealth gap and advance racial equity. But the lawsuit argues that those statements constitute an “improper racial motive” and violate the constitution’s guarantee of equal protection of the laws.

“The White House has indicated that one reason to do this is that they believe it would disproportionately benefit certain racial groups,” said Rick Esenberg, president and general counsel of the Wisconsin Institute for Law and Liberty. “The racial motivation supports these taxpayers standing to challenge [the policy] and informs yet another constitutional difficulty with the program.”

Shit, by their rationale, any tax break that disproportinately benefits white people would be a violation of the equal protection clause.

But they probably know that and this is more an election stunt.

If it benefits anyone other than straight white males it's "improper " to them even if it benefits straight white males.

Since the percentage of white households with estates over the $11 million exclusion, then to make it more race neutral that will need to be moved down.

"it would disproportionately benefit certain racial groups". They note that this is only one reason why Biden's forgiving student debt, and even that one reason is not guaranteed to "disproportionally benefit certain racial groups," as the overwhelming majority of college attendees are white, so that's the racial group most likely to benefit from dismissing student loans. Assholes are really stretching, here.

A federal judge in Wisconsin has dismissed a lawsuit from a taxpayers group seeking to block President Joe Biden’s student loan forgiveness program, ruling that the group doesn’t have standing to bring the lawsuit.

The Brown County Taxpayers Association argued that Biden’s order unlawfully circumvented Congress’ power over spending. They also argued the plan was discriminatory by seeking to give particular help to borrowers of color.

U.S. District Judge William Griesbach, an appointee of President George W. Bush, tossed the case Thursday, writing that the group does not have standing to challenge the plan simply because they are taxpayers.

Biden enacted the debt relief plan under the HEROES Act, which was passed after the Sept. 11 attacks sparked an American-led military campaign aimed at terrorism. The act gave the executive branch authority to forgive student loan debt in association with military operations or national emergencies.
