Mehta is reviewing the evidence from the bench.
It is a Facebook comment on a public post by individual named John McGraw. AUSA Jeffrey Nestler Caldwell made a statement around this post that inferred the OKers would not be peaceful going forward (assuming post election)

Mehta has agreed to admit this evidence because its not predjucial, but probative

"I know what a meme is," Judge Mehta says when def atty Geyer (for Harrelson) raises an objection to an image that will be admitted. Geyer essentially arguing its not clear if comments were rhetorical or not
Mehta says, (lightly paraphrasing): that's sorta the main dispute here

The prosecution wants to admit Caldwell's reply to a Trump retweet appearing on FB and an ongoing convo about "fighting for Trump"

"If we don't start mowing down masses of these shitballs they will come for all of us. Its kill or be killed I am afraid. ...I kinda hope there is some shit tomorrow in some ways just so we can get on with it."
