(42,704 posts)And every year the majority of them are based on a complaint about a decision made by the judge. And those complaints are dismissed because the Code of Judicial Conduct is clear:
Judicial-Conduct Rule 4(b)(1) ;[c]ognizable misconduct does not include an allegation that calls into question the correctness of a judges ruling, including a failure to recuse.
The rationale for not treating a judge's decision-making as the basis for a misconduct complaint is explained as follows:
Rule 4(b)(1) tracks the Act, 28 U.S.C. § 352(b)(1)(A)(ii), in excluding from the definition of misconduct allegations [d]irectly related to the merits of a decision or procedural ruling. This exclusion preserves the independence of judges in the exercise of judicial authority by ensuring that the complaint procedure is not used to collaterally call into question the substance of a judges decision or procedural rul- ing. Any allegation that calls into question the correctness of an official decision or procedural ruling of a judge without more is merits-related."
Every judge makes rulings that are appealed and sometimes those decisions are reversed and sometimes they are upheld and sometimes the decision is unanimous and sometimes its a split decision. That is the system for reviewing a judge's decision making and its not clear how it would work -- and who would be the ultimate judge -- if a decision that was upheld or even one that was reversed could then be reviewed again, not to change the outcome but to punish the judge.

(16,959 posts)I have to say here though, that THIS particular judge (in my eyes only) has let TFG destroy her. I don't know her from Adam, but after her thinking here, i DO NOT think she could ever make a right decision. Again only my personal thoughts.
