Laurence Tribe agrees with Andrew Weissmann: Time's up, DOJ.





Weissmann:

Times up, DOJ. The rule of law requires Trump be held to account, as others have been for like crimes. It's been over 14 weeks since the MAL search and many months since the DOJ investigation began. Timely action is needed.


Tribe:

Yes. Time's up, DOJ. I know that Merrick Garland, who has devoted his life to the rule of law, will do the right thing. But that requires him to indict now. Even waiting till the Dec. 6 runoff would be wrong, and there's no excuse for delaying things by naming a special counsel.

Tribe is going to get a spanking here. He doesn't understand how the system works. DOJ needs to do what it needs to do, and, it doesn't leak.

nor does he know what other evidence DOJ is pursuing or what evidence it has that would be used by the defense.

Just saying "indict" is easy. Going out and convicting someone isn't. I keep hearing echoes of Donald Rumsfeld's "slam dunk" prediction when I see people demanding that Garland act yesterday.

The message being sent is that if you have enough money to obfuscate, delay, appeal, play legal games and hide behind non-existent immunity, you can get away with big crimes.

But nonetheless facts are facts, and speculation that the DOJ ‘is doing nothing’ is not based in fact.

While DOJ doesn’t leak, there are lots of stories about court cases etc that hint what the DOJ is doing behind the scenes.

And they aren’t sitting on their asses.

There are two grand juries at hard at work reviewing exidence and testimory. One for stolen docs, the other for Jan 6th.

There’s apparently a hush hush court case going on where Trump’s bogus claims about ‘executive priviledge’ and ‘attorney client privilege’ are getting blown up. That’s going to free up a lot of lawyer witnesses to tell about their private convos with criming Trump.

And plenty of DOJ filings to read, as well as stuff coming out from Judge Dearie, who clearly sees thru Trump’s garbage bullshit in the documents case.

Surely they understand that DOJ cannot use ANY documents seized at MAL as evidence in prosecuting Trump until the appeal to the 11th circuit regarding Cannon’s rulings on the special master are resolved.

I believe DOJ just today filed a request to the appeals court to release to DOJ approx. 80% of the seized documents that Trump has not made EP or personal property claims against.

Without evidence, there is no indictment.

I am very happy to see Dearie sees the Trump lawyers are full of bullshit. That’s gotta help the DOJ with their appeal to the 11th circuit about Cannon’s ruling.
