Judge backs penalties against county in voting machine case

HARRISBURG, Pa. (AP) A Pennsylvania judge has recommended the states high court impose civil contempt penalties against a Republican-majority county government that this summer secretly allowed a third party to copy data from voting machines used in the 2020 election lost by former President Donald Trump.
Commonwealth Court President Judge Renee Cohn Jubelirers 77-page report issued late Friday said the July inspection and copying of computer data from machines rented by Fulton County was a willful violation of a court order designed to prevent evidence from being spoiled.
She recommended that the justices find that the county, based on the actions of Republican Commissioners Stuart Ulsh and Randy Bunch, engaged in vexatious, obdurate, and bad faith conduct in their lawsuit against the Department of State over whether a 2021 inspection by another outside group meant the machines could no longer be used.
Cohn Jubelirer, an elected Republican, recommended that the county be ordered to pay some of the states legal fees and that the Dominion Voting Systems Inc. machines in question be turned over to a third party for safekeeping at the countys expense.

Harrisburg, PA Acting Secretary of State Veronica W. Degraffenreid has informed the Fulton County Board of Elections that she has decertified the county's voting system for future elections because it was subjected to a post-election review by a third party in violation of Pennsylvania's Election Code.
"I have a statutory obligation to examine, evaluate and certify electronic voting systems," Secretary Degraffenreid said in a July 20, 2021, letter to the county. "These reviews include verifying that the voting system conforms to federal and state law and any regulations or standards regarding confidentiality, security, accuracy, safety, reliability, usability, accessibility, durability, resiliency, and auditability."
Earlier this year, Fulton County officials allowed Wake TSI, a company with no knowledge or expertise in election technology, to access certain key components of its certified system, including the county's election database, results files, and Windows systems logs. The county officials also allowed the company to use a system imaging tool to take complete hard drive images of these computers and other digital equipment.
"These actions were taken in a manner that was not transparent," the Secretary said in her letter. "As a result of the access granted to Wake TSI, Fulton County's certified system has been compromised and neither Fulton County, the vendor, Dominion Voting Systems, nor the Department of State can verify that the impacted components of Fulton County's leased voting system are safe to use in future elections."
The third-party access to Fulton County's voting system undermined the chain of custody requirements and strict access limitations necessary to prevent both intentional and inadvertent tampering with electronic voting systems. The unauthorized access prevents the vendor from affirming that the system continues to meet state and federal certification standards.

Pennsylvanias top election official has decertified the voting machines of a small southern county that disclosed that it had agreed to requests by local Republican lawmakers and allowed a software firm to inspect the machines as part of an audit after the 2020 presidential election.
The action by Acting Secretary of State Veronica Degraffenreid almost certainly means that Fulton County will have to buy new voting machines or, as it did in the May primary election, lease new ones. Degraffenreid notified Fulton County officials in a letter Wednesday that the inspection by a firm with no knowledge or expertise in election technology violated state law.
I have no other choice but to decertify the use of Fulton Countys leased Dominion Democracy Suite 5.5A voting system last used in the November 2020 election, Degraffenreid wrote.

Fewer than 8,000 people in Fulton County voted in the election, backing Trump by almost seven-to-one over Democrat Joe Biden. Biden went on to win Pennsylvania by more than 80,000 votes.

Fultons audits in Dec. 2020 and Feb. 2021, backed by pro-Trump Sen. Doug Mastriano and others, were conducted by the company Wake TSI which worked as a contractor to a nonprofit operated by Sidney Powell, who represented Trump in election challenges.
