Trump is having trouble grasping the reality of the 11th Circuit's decision

In light of the 11th Circuit's decision vacating Cannon's order establishing the special counsel process and enjoining DOJ from using the non-classified documents in its investigations, the DOJ today filed a motion with Cannon asking her to extend various existing deadlines that would otherwise have to be met if the 11th Circuit's mandate isn't issued on December 8 per the 11th Circuit's order. DOJ pointed out that meeting those deadlines would be a wasteful expenditure of resources if the mandate issues as scheduled.

Trump has opposed the extension, seemingly demanding the special master process continue as if nothing has changed.

even some republicans recognize that Trump, Kanye, and Hitler are not the proper theologians for their party going into 2024. They are currently moving away from the nazi leadership with the speed of a sea anemone. Even they know that the institutions held, and have regained their footing. And that Trump is in real trouble. Real trouble, and worse.

Not being a Debbie downer here, but Garland’s lack of subpoenas for congressional members in order to not look political makes me really nervous.

Just seems like it's just a stumbling block.

But, I like Item 3:

"3. President Trump opposes modification of the current case management order at this time."

What the hell does that mean? I thought that the current case order was dismissal of the action. Guess I'll go back and reread the 11th Court's opinion. However, are they reserving the right to appeal? 'Cause, they can do that anyway. They are in trouble.

So, I can't find what DOJ filed prior to this response, but the Special Master is GONE, so how can they oppose this case management order in any event? Isn't this a case of getting Cannon to do what the 11th Circuit told her to do, by the 8th, 'cause if she hasn't acted by then, then other old deadlines for stuff kicks in? I have lost track of what deadline tRump's "team" might benefit from.

I don't see any reason given for wanting to deny an EXTENSION of time for tRump to do something. But, I'll bet Cannon gives it to them, because, you know, Cannon...

This is just dumb stuff. Hey, Cannon, you look bad, Dear. But, go ahead, grant their request. The Government is ahead, and I'll bet they are prepared already. Only Donald is trailing.

The 11th circuit decision effectively terminating the special master process and Trump's case will take effect next Thursday unless it is stayed. Moreover, there are several deadlines that wouldn't have to be met if the the decision takes effect next week. Rather than have the parties and the special master continue to the work that would be needed to meet those deadlines, DOJ asked Cannon to extend those deadlines for a week. That way, if the 11th circuit order isn't stayed, no one has had to incur the expense of preparing to meet deadlines that are moot. On the other hand, in the unlikely even that the 11th circuit decision is stayed, the deadlines will only have been pushed back a week. It makes perfect sense. Of course, Trump can't accept the possibility that the 11th Circuit decision might actually take effect next week, so he has opposed the extension of time It's ridiculous. And while Cannon has shown herself to be an idiot, even this should be a no-brainer for her. I guess we'll see.

I love to read the filings! It looks like they will appeal. I guess that is what they meant.

It looks to me like they not only threw out the Special Master, but then they instructed Cannon to dismiss the underlying action. “For that reason, we VACATE the September 5 order on appeal and REMAND with instructions for the district court to DISMISS the underlying civil action.” So, to me it looks like Cannon has to kick Donald out of court. I think the 11th Circuit was pissed.

If they want to continue, they have to appeal to Clarence, amirite? Otherwise, they're dead in the water. The "underlying civil action" is the entire thing, right?
