I hope that Breyer and Ginsberg consider retiring now so they know they have a Democrat President picking their replacement.
I'm wondering if Scalia or Kennedy can make it til the end. Scalia never looked healthy and he is the 2nd oldest on the bench (76 is his age, just a few months older than Kennedy)

(14,040 posts)unless he dies suddenly, he'll be that demented Justice that people want to urge to retire but he won't until a Republic is elected.

(19,114 posts)Hope they all remain healthy, but wouldn;'t it be something if all 4 retired? Obama would get to pick 6 of the 9 justices. The court would be shaped by Obama for decades.

(11,619 posts)If partisan concerns of succession drove her, Ginsberg's health issues would likely have pushed her to retire before an election that many suspected and broad casted would be close.
I think that if Ginsberg, Breyer, and Scalia (Oh my!) are content doing their job for another 4 years, and can do the work, they will continue. It will be health that takes them off the bench, not political concerns.
Because they are at an age when the body can give out unexpectedly, I'd bet that two of them will retire.
I'd bet one of those won't be Scalia. It has nothing to do with his partisan tilt. I just think he is too mean and arrogant to leave anyway but feet first.

(2,237 posts)Ginsberg may have the best healthcare in the world, but the chances of survival for someone with cancers she's had aren't good.
Breyer is at least seemingly pretty healthy, but I'd prefer he retire in the next 4 years to.
I doubt Scalia and Kennedy will retire.
