A former president has never been indicted in a criminal case before.
Everything from this point forward is unprecedented.
However, once we cross the Rubicon, there is no going back. We must press forward and our North Star must be the rule of law and our Constitution.
Trump took classified documents that he was not entitled to take and he planned on keeping them. After a year of the NARA attempting to get the documents back from him, he was still giving them the run-around, until they requested that the DOJ issue a subpoena for them to get the documents returned to the proper owners, the American people.
Even then, he lied to the FBI when he told them there were no more documents. In just a few hours of searching, they were able to retrieve hundreds of documents from the Trump property at Mar-a-Lago. It was never about not having "enough time" to search for all the documents. It was about hiding the documents that he wanted to keep and obstructing the authorities from finding them. He had no more claim to the documents than the average citizen, when he was no longer the president.
How could he not know there were classified documents in his desk and why did he not choose to hand them over immediately?
The major issue seems to be in what venue were these crimes committed and what state will he be indicted and prosecuted? Defense lawyers are attempting to obfuscate and to blur the facts of what happened, but no amount of lipstick will make this pig look like Marilyn Monroe.

(2,517 posts)It was he, and all of his enablers, that knowingly elected - at every step of the way - to break precedent. This has included what we all feel like are crimes and other unseemly activity while in office (putting it mildly).
If our country's constitution and its 247 years of legal precedent are worth defending (and for all of our faults it is IMO) then donnie-t must have his day of reckoning if the grand jury(ies) indict.

(6,377 posts)if you look at it from the perspective of an attempted fascist takeover, it is understandable. We are currently in the middle of fascists attempting to save their leader. We beat back the coup, brought in prosecutors to take them to court, and hopefully they will all be indicted and tried for this. Trump especially needs to be treated like the Trump Crime Family Boss that he is. He is a wannabe Hitler disciple who will destroy our country if he is reelected.
I am constantly stunned by the remarks and activities that the Repubs are coming up with. Their whole half of Congress is fascist. Their only concerns are how to extricate Two Scoops from his predicament, not governing or the welfare of the People. They serve Donald, and that's it.
It is just surprising about the extreme stupidity that surfaced, something which to me was something I'd never seen, elected officials with power over us but no brains, and throwing tantrums at every step. I am no longer naive, and I don't fall for crap anymore. At least, mostly. That is why it is important to share info and ask questions.
Currently, the GOP is threatening shenanigans if we indict Trump. Well, let's go, then! Donald deserves to be picked up, placed in handcuffs, and carted off to jail until he makes bail. But, that's not going to happen to him. The indictment will, however, and the argument can be made that it is for the good of the country.
I want police procedures followed; no special handling of an exceptional perp. He is facing so much jail time, he should flee immediately. We should be keeping watch on the harbors in Florida, and see who shows up.
