(42,702 posts)They don't all involve providing information to a foreign government of agent of a foreign government with the intent or reason to believe that such information is to be used to the injury of the United States or to the advantage of a foreign nation, which is the part of the Espionage Act that the Rosenbergs were found guilty of violating and which expressly allowed for the death penalty at the time.
I doubt that is the provision that Trump will be accused of violating. Rather it more likely will be one of the "lesser" espionage act offenses that are subject to a maximum penalty of 10 years.

(2,421 posts)while I don't see tfg getting the death penalty, I wouldn't be so sure he hasn't shared that info with foreign agents. I'd lay even money he and Kushner sold the Saudis the Iran info -

Only two provisions of the Espionage Act address the retention of sensitive documents -- Sections 793( d) and ( e). The maximum penalty under those provisions is ten years.
If he was going to be charged with a violation of other provisions provision of the Espionage Act, that information would be coming out.
My bet is that he is not going to be charged with sharing information with a foreign government.
Will know early next week.
