unless and until he's convicted of treason or murder, i don't think the death penalty is a thing in this case.

And my understanding is that donnie is being charged with breaking the same law that got the Rosenberg executed.
He won't actually get the death penalty, but it's technically possible under the espionage act he's being charged with.
I don't believe in the death penalty, I just want him to face the karma he deserves for calling for innocent people to be executed.
