(a) The following persons are subject to this chapter:
* * * * * * * * * * * *
(4) Retired members of a regular component of the armed forces who are entitled to pay.

President Obama has authority to prosecute Petraeus if the incident occurred before 31 August 2011 when Petraeus retired.
822. ART. 22. WHO MAY CONVENE GENERAL COURTS-MARTIAL
(a) General courts-martial may be convened by—
(1) the President of the United States;

Why do these members of congress think the FBI should notify them of their investigations? This smacks of partisanship and interference in FBI investigations. Do they want the FBI or CIA to stand down if the investigation involves an ally of the rethug party? Seems like it.
