Judge Slaps Husted’s Last-Minute Ballot Change In Ohio

Ohio Secretary of State Jon Husted’s last-minute change to how provisional ballots were handled violated the Constitution and Ohio election law, a federal judge ruled Tuesday.

Husted ordered elections officials on Nov. 2 to only count a provisional ballot if the voter had noted what type of identification he or she was using. But U.S. District Judge Algenon Marbley ruled that Husted’s directive could disenfranchise voters and called it “a flagrant violation of a state elections law,” according to the Plain Dealer.

Marbley noted that Husted’s order came just days before the election, yet the secretary had previously told federal courts that he couldn’t comply with other rulings because they were handed down too soon before the election.

Marbley ruled that Husted’s order violated a state law that puts the burden on poll workers to properly complete a provisional ballot form. He ordered Husted to issue a new directive by noon on Friday before officials begin counting the provisional ballots.

an average of 10% of voters at that polling location were asked to cast a provisional ballot. This percentage was based on the amount of electronic ballots cast at that polling location, and the numbers of provisional ballots that were required to be cast.

TEN PERCENT IN MOSTLY TRADITIONAL DEMOCRATIC VOTING AREAS. If this election were close, and Husted's antics got half or all of those provisionals to be uncounted, do you think the election in Ohio could have been different? If this was a norm as far as percentages go, then it certainly happened this way in ALL poling locations in more populated areas...monitored or not.

Husted is no more or less than Blackwell was..his puppeteers are just slicker now. Imagine what 2016 will be like...eventually they will find a way to make election manipulation actually work..they are close now...each cycle is a new run at new ways to take it away from the people.

Nobody should think they will give it up, no matter how many times they lose. They know they'll get some past the system.
