Suspect in 2021 SF stabbing case of 94-year-old Asian woman gets probation

Everyone here in the Bay Area is furious. To be clear, this isn't the prosecutor. This is the judge.

"Ninety-four years old at the time. Taking a walk in the morning, where she was violently, viciously stabbed multiple times by a violent repeat offender who should not have been walking on the streets to begin with," said public safety advocate Lily Ho. "In return, the judge said, 'It's fine. Let's just give him probation instead.'"

They were joined by Jenkins and San Francisco Supervisor Matt Dorsey.

"If there is no accountability for the people who attack them, if we don't have adequate consequences for that behavior, it will continue," Jenkins said.

Public safety advocates say they are demanding courts end the release of violent repeat offenders and restore public safety on the streets of San Francisco.

"Mr. Cauich acted when he was in a mental health crisis, homeless, abusing substance, victim of a hit and run. SFDA prosecutors did not provide him with adequate services. Mental health deteriorated. When he attacked Ms. Taylor, he didn't know what he was doing. Attorneys had to tell him that he stabbed someone. When he was showed the video, Cauich sobbed. Mr. Cauich did not act out of hatred -- not a case of racial hatred," said Cauich's attorney, Lisa Dewberry in a statement.

If what Cauich's attorney says is true, then the state failed by not providing him with health services for his condition. A crazy person
crazy at the time of the crime cannot be held to the same standard.

If your mental state is such that you stab people when you have an episode, you are a danger to the public and need institutional help in a facility that can manage your violence. Not out on the street trying to get clean with some help.

On Friday, almost three years after the incident happened, the prosecutor from Jenkins’ office and Lisa DewBerry, who is Cauich’s defense attorney, appeared in court after Cauich pleaded guilty to multiple charges.

The judge, Kay Tsenin, read the sentence and said that Cauich can avoid jail time but is required to enter probation and a strict behavioral and mental health treatment program, which means he will be under intensive supervision in a facility with limited freedom until he successfully finishes the program.

The court combined the attack and another burglary case for this sentence.

A program called the Intensive Supervision Court—intended for high-risk probationers as an alternative to state prison—will decide later what specific programs Cauich will undergo. If he violates any probation rules, he will be sent to prison.

“I am giving you one last chance to stay out of state prison,” Tsenin said to Cauich during the hearing.

I read the facts before posting the article. The guy has a rap sheet a mile long. He was previously arrested for murder, and they had to let him go. Assuming he completes the program, he'll be back on the streets.

But hey, more chances. Fuck the Asian grandma he almost killed. Tough for her, I guess.

The AAPI community keeps seeing "tough for our elders" in the Bay Area. It's weird how it keeps happening.

At least Brooke Jenkins knew the score.

Daniel Cauich, the suspect in last week's random stabbing on Post Street that injured a 94-year-old woman, was released from jail in 2019 after serving three years pending trial for murder. The main reason: Cauich and his brother, who were both charged in the 2016 killing, were not properly Mirandized after their arrest.

The outcry about last week's stabbing is likely to continue, with Cauich being the latest allegedly violent suspect with an extensive rap sheet in San Francisco to be implicated in a new crime after being freed from jail. In Cauich's case, all of his most recent charges were burglary-related, and his most recent arrest in May came just over a month after his release from a 100-day stint in jail. Court records obtained by SFist suggest that he'd been required to seek outpatient treatment for unknown substance-abuse issues.

But the charges against him in 2016 were much more serious, and we're just now getting a clearer picture of what happened in that case that led to the 2019 release of both Cauich brothers and the dismissal of their charges.

55-year-old Larry Peevey was killed at the 16th and Mission BART plaza on June 5, 2016. Daniel and his brother Header Couch, along with another man, Jose Poot, were arrested and all three charged in Peevey's murder. As the Examiner reported at the time, Peevey was killed with two knives and a hatchet — and police had grainy surveillance video of the crime.

If he's been sentenced to probation, that sounds like the final adjudication.

So why does it say,

Public safety advocates say the court hearing for Cauich will be rescheduled because the lawyers and judge are not ready to consider the case.


and later it ends with this,

A new court date has not been set yet.


I didn't read about any appeal in the article – and can the prosecution appeal, anyway?
