South Carolina Will Use Gerrymandered Congressional Map in 2024, District Court Rules

WASHINGTON, D.C. — The same federal court that struck down South Carolina’s congressional map for being an unconstitutional racial gerrymander ruled today that the state can use the map in the upcoming 2024 elections.

This decision comes after Republican officials asked the court to pause its January 2023 decision that blocked the map and ordered a new one for 2024. Today’s order states that because the June 11 primary is rapidly approaching and a new map is not in place, “the ideal must bend to the practical.”

South Carolina voters have gone over a year without a fair congressional map. With today’s order, justice is delayed once again to Black voters in the state. The U.S. Supreme Court has yet to issue its opinion on the merits, which the court cites as a reason for this delay.

In January 2022, the Republican-controlled South Carolina Legislature passed a congressional map that drastically changed the composition of the state’s 1st and 6th congressional districts. The South Carolina State Conference of the NAACP and a voter filed a lawsuit challenging the congressional map, alleging that the map was an unconstitutional racial gerrymander in violation of the 14th and 15th Amendments.

1. Courts should commission their own map at the beginning of these trials,

and default to the court's map if the proponents of the crooked map stall to try to get such a ruling.

2. I teally don't get this. Courts keep allowing use of illegal maps.

Thus causes harm to everyone in the affected districts possibly the entire state or entire country.
I thought the courts goal was to reduce harm.
This increases harm, not just now but for at least 2 years into the future.
It’s such a miscarriage of Justice.

Both sides in the case told scotus they needed a decision by January 1st.

This case has been languishing at scotis since November of 2023. They still haven't ruled on the appeal.

The district Court, even though it found blatant racial gerrymandering occurred, couldn't wait any longer, and allowed the current maps to be reused.

This is nancy maces district btw.

Shame on scotus.

Somebody should insist the same court apply the penalty required by the 14th since South Carolina isn't going to fix the problem before the next election

6. Never enough time to change to fair maps if that would make electing Republicans less likely.

As Democrats win statewide elections for political offices not affected by gerrymanders (Governor, US Senator, State Supreme Court, etc.), one hopes these maps will eventually return to being more fair (as with Wisconsin).
