Nothing he doesnt already know about, of course.
He should have the hearing concerning the gag order and the harassment and disrespect towards the jurors. He should require Orangina to sit in a side room with a TV monitor and closed circuit communications with his lawyers. Then and there he can do all the wild gesticulating, cursing, muttering, and explosive sharting he wants.

(241 posts)Locking an innocent until proven defendant in a holding cell will only add to whatever appeals the lawyers make in case of a conviction as prejudicial.
And no judge wants to be overturned.

(47,579 posts)He was ordered to turn himself in, at which time he was booked, charged with crimes, and released pending trial. There must have been terms for his release, just like every other criminal defendant. Bail is one way. OR (Own Recognizance) is another, and that one basically amounts to zero dollar bail. Thats what I was getting at. Hes still on some kind of leash. Hes not a 100% free man right now.

(10,927 posts)Just because there were no handcuffs or mug shot means nothing. By surrendering, he's voluntarily placed himself under control of the New York court until the trial is over. No arrest needed.
So far, the court has been very lenient, but that can change.

he is not in his right mind. just because were used to it doesnt change that.
A defendant is assumed to be responsible for his/her behavior absent the attorneys claiming mental state as a defense.

I'll bet that the Judge is working with court personnel this weekend to secure closed circuit TV and a phone line for this purpose. No need to make elaborate arrangements for this crook, every court that I know of has at least one holding cell near the courtroom.

why should the court do it now? Let the world see exactly what hes about, how he handles stress, how he acts when facing bad news. If its shown he cant handle himself to defend his own actions how is he qualified for the presidency?
We have the option of not watching or reading about it the jury doesnt they should see and hear the full trump.
This. Keep him in full view (and odor). Harder to post on his phone that way, as well.

(5,184 posts)Let the orange gibbon be the one to devolve the trial into chaos. Maybe then we might take the threat he and his backers represent with a little more seriousness. It seems like there has been a drop in the vitriol that his presence in this country represents and it does none of us any good to allow that to happen. I sincerely hope that he finally does push the judge to put his ass in a holding cell. Then, as suggested above, they can control his ass by sticking him in a room where he can run around hooting all he wants. It is this level of precaution that is what is needed. Hell, this is where the dialogue about his presence in the courtroom should start!

(10,938 posts)He is free to comment on the defendants lack of respect for the jury if he chooses. Then the jury is welcome to consider that in their deliberations. Since they will already be considering how TSF ignores all laws as being for "the little people" they will have the chance to pile on because of that.

(32,106 posts)No, the judge can't make comments about the defendant's conduct towards the jury. He would be overturned on appeal. The jury can't consider that in deliberations. The conviction would be thrown out. Your law school should give your money back.

(3,527 posts)without his lawyer or phone - just two sheriffs and a teevee. No talking. Monitored on video showing in the courtroom. He returns at the end of the day to dismiss the jury and stand for them. Then, the next day, reset.

(42,796 posts)Can you point to a recent precedent involving someone on trial for a non-violent crime being kept away from his lawyer? From what i've been able to observe, Judge Merchan is a pretty smart judge and not likely to make that kind of mistake.

(1,329 posts)He should have to sit there and suffer from the cold, the humiliation, and the powerlessness. His lack of dignity, self control and stamina will be on full display. I hope the judge gives him the sit down and shut up treatment repeatedly. If he has to punish Trump, have him do a couple hours in a holding cell while the court takes a break. That would be delicious.

Your suggestion is probably the best option for actually keeping the Jury insulated from his bullshit. Jailing him might also be worth a shot.

(6,573 posts)in this instance is to keep him from outing the jury and exposing them to potential injury. Who cares what he does in front of the judge. The judge will remove him at the point the trial stops because of him.
Do you remember the case where the man mowed down multiple victims with his car during a parade? He was a "Sovereign Citizen" and was acting as his own attorney. The judge was a lady who handled his many outbursts with banishment to a room where he could hear the proceedings, but she could cut off his mike when necessary. Sounds like the reporter room in this instance.
I think that Trump can't go to lock up without a full hearing, but he could be removed to the reporter room. Or whatever that room is called. Or whatever room there is available like that.
I think we're looking at fines and a threat of action. Also, if Trump continues to fart, maybe the judge can order him to see a doctor on Wednesday. Just a thought. It isn't fair to the jury to have to suffer through frequent farting.

(25,612 posts)We know that he is fecally incontinent. The crew from The Apprentice spoke of it in grotesque detail, defying their NDAs.
This in my opinion is a major reason why hes so upset that he cannot leave when he wishes. Hes in trouble down there.

(42,796 posts)Judge Merchan is a careful judge. The Darrell Brooks precedent you cite -- he was the guy that drove through a holiday parade in Waukesha, WI, involved a defendant who was representing himself, would loudly speak over the judge and prosecutors and even refused to admit to his name. Trump hasn't done anything like that...yet.
