Justice Samuel Alito was not present on Friday morning as the Supreme Court handed down opinions in the courtroom, the second day in a row he has been absent.
Alitos absence, for which the Supreme Court has not provided an explanation, is unusual because its the end of the term and the justices have issued nine opinions over the last two days.
One of the opinions on Friday included upholding a federal law that bars guns for domestic abusers, rejecting an argument pressed by gun rights groups that the prohibition violated the Second Amendment.
Alito has been in the news recently for controversial flag displays outside of his properties, including a US flag that was flown inverted outside the justices home in 2021 and another flag that was on display during the January 6, 2021, attack on the US Capitol that was flown outside Alitos vacation home in New Jersey.

And if so, the Republicans can be counted to fight it, betting that everything will be peachy-kern again if they can reinstall the donald in the White House. But theyre also up against a longtime player whos smart, experienced, and usually underestimated.
Biden could do some sort of emergency appointment that would allow him singlehandedly to install a new Justice who he could elevate more formally with Democrats help after he wins in November (which I think will be what happens). Just up n DO IT.
Heck, theres an ongoing conversation/argument about presidential power all the time, anyway. Nobodys declared any absolute on the issue yet, have they? Why shouldnt Biden go for it? Hey, you KNOW the donald would.

(15,773 posts)I don't really think either of them have ill-gotten gains. Just because they were gifted fancy vacations, doesn't mean they have extra cash. Poor babies might have to live on their government salary and pension.

There are millions of women and their families who are facing the most horrible experiences since the Dobbs decision. There are millions of Americans facing a horribly difficult time getting themselves registered (or approved) to vote. The Citizens United ruling has created horrible corruption in our country, and allowed the dark forces to flourish.
And ALL OF THAT is on the "conservative" (radical right wing) justices.

(1,933 posts)Hypothetically, if a Justice was to croak or become incapacitated after a case is deliberated but before a ruling is issued, is his/her vote and opinion part of the ruling? Ive never seen any discussion of this.

I am not completely versed in how it all works, but no doubt they come to decisions first, then write out their reasoning (opinions) both for agreeing or dissenting. Depending on the case, that can take some time.
The fact that Slimy Sam wasnt there today has no bearing on the opinions presented today.

(2,231 posts)Yes. The vote was done weeks or months ago. The time in between the vote and release of the opinion is taken up by writing and rewriting opinions before the final approval is given by the Justices. Then it's slated for release.

There is no real way to put social or political pressure on a SC Justice. Our system was specifically designed to insulate them from those pressures.

He doesn't want to retire yet, because he doesn't think he's done enough damage to our democracy or advanced the cause of Christian Nationalism far enough. He's insisting she hold on till after the election in the hope of not having to retire with a Democrat in the White House. She's not happy.
No, I don't know if any of that is actually true, except for her desire to let her freaky flags fly. But it's fun to Imagine!
