Treaty Rights for the Disabled

Published: December 3, 2012

The United States is a global leader in defending the rights of people with disabilities, thanks largely to the Americans With Disabilities Act of 1990, one of President George H.W. Bush’s crowning accomplishments. Now the Senate has a chance to extend the spirit of that law — and with it, real protections for the disabled — beyond our borders. It can vote on Tuesday to ratify the United Nations Convention on the Rights of Persons With Disabilities, which declares that all citizens, regardless of ability, deserve to live in dignity, safety and equality under the law.

Signed by President Obama in 2009, the treaty has been ratified by 125 countries. The Senate Foreign Relations Committee approved it last July in a bipartisan vote, 13-6, while also passing a resolution to clarify, in case anybody was worried, that the United States would surrender none of its sovereign authority by joining the convention. The the treaty would have no power to alter or overrule United States law, and any recommendations that emerge from it would not be binding on state or federal governments or in any state or federal court.

But it would encourage other countries to bring their treatment of the disabled up to America’s gold standard, the A.D.A. That is more than enough reason to support it. A broad array of disability-rights groups say also that the treaty’s benefits for disabled Americans traveling abroad, particularly veterans, will be considerable.

I looked at the tally, saw "61 Yeas" and thought "No, they beat the filibuster!" Forgot treaties need a 2/3 vote.

i used to write to him to shame him into representing something other than the republican party but at a DU meetup here in the triangle i learned that he takes those letters as a sign that he's doing something right.

i wonder if we can get him voted out. that would be sweet.

They believe "the treaty “crushes” American sovereignty and opens the door to bureaucrats taking disabled children from their parents’ arms", as Frothy Santorum puts it. In other words, the Global Boogeyman is out to get the widdle children.

Tomorrow will the 'moderates' will be wailing for compromise with the 38 and telling us they have great ideas and the President must be the President of everybody, so we have to give the Republicans what they want? We shall see what we shall see.

Anyone who voted against the Treaty Rights for the Disabled is heartless and not fit to run this country. The Senators need to wise up and call for a second vote and pass this Treaty. Just saying.

BTW our republican senator here in IL didn't vote because he can't work yet because he is disabled post stroke. But, I think he would have voted with the dems even before his debilitating stroke.

Chambliss (R-GA) - a particularly foul stinker who badmouthed triple-amputee Max Cleland to get the job in the first place. Still, in Georgia, any statewide win is a serious longshot for Democrats.

Cochran (R-MS) - another deep-south longshot

Roberts (R-KS) - a slim possibility, maybe if some skeletons turn up in his closets

McConnell (R-KY) - best chance so far, i think; he's at the heart of a long legacy of bullshit, so it'll be easy to pin all kinds of blame on him

Johanns (R-NE) - i know less than nothing about this particular chunk of whale dung, maybe some brave soul from Nebraska can comment on his chances

Enzi (R-WY) - likes to portray himself as a moderate; if we're lucky, he could lose in the primary. This vote was probably aimed at shoring up the Wyoming nutcase base against such happenings.

Graham (R-SC) - seems like this guy makes an ass of himself every day lately, this is a possible pickup IMHO.

Alexander (R-TN) - freaky as hell but powerful and politically astute with a long history, seems like he picks his fights carefully. I think, based on this, we have to conclude that there's a perceived direct political advantage to voting against the treaty, and given the rationale (U.S. sovereignty) it has to be similar to Enzi's - shore up the "UN is coming to take your guns" voters. Could be a possibility, but tricky.

Cornyn (R-TX) - It's tempting to say that anything Texas is automatically out of range. Still, something could happen, and if Hispanic voters decide to turn out en masse while caucasian males stay home, we could see things start to turn in Texas.

Risch (R-ID) - Problem is finding a Democrat to run against this mega-asshole. It's dangerous out there.

Inhofe (R-OK) - Blech. Little would give me greater political thrills than seeing this dickweed go down in flames, but I think his seat is safe.

Sessions (R-AL) - ditto.

That's ALL of them (yep, another Democratic-incumbent heavy senate election). Every single GOP senator up for re-election voted against the treaty. They should be held accountable by their constituencies, but it's unlikely that any will be. I'm seeing 2, maybe 3 potentially weak ones in the lot, but overall we're looking at winning in the south which is a real trick these days.

Lawrence O'Donnell got this one right. Today the United States Senate disgraced itself.

This is personal for me. I've been legally blind all of my life. I know that it is hard to grow up with a disability and to endure the scorn and prejudice of others. Yet because of legislation like the Americans with disabilities Act millions of people with various challenges are living fuller lives in the United States. I've spent the last thirty five years educating myself (doctorate in education) and serving as a teacher and and an advocate for people with special needs and their families. I have done enough political work in this area to know that it is entirely possible to do bipartisan work in this area. This isn't a political fight, it is a human rights situation. There was no excuse for senators to vote against this extension of rights to the disabled community around the world.

This was a scene where the men went home for the holidays, the mice showed up, and the disabled got coal in their stocking. The excuses were so lame. Some crazy ass people from the homeschooling movement decided that this was going to cause them to lose the right to homeschool their kids. I feel sorry for those kids because their parents are so fucking ignorant that they obviously don't know the difference between the ADA, the IDEA, their ass or their face. Even when Bob and Liddy Dole were escorted to the floor, the cynical, politically driven Republicans couldn't look their old colleague in the eye and conjure up the balls to vote yes and say to the Tea Party idiots "Fuck you, I'm voting yes to this because it is the decent thing to do and if you don't like it, bring a friend to the next primary and we'll talk." What a bunch of chicken shits. And they are still asking themselves why they got their asses handed to them in the last election?

Lawrence O'Donnell was right.

You would hope this would be personal for him. He's recovering from a massive stroke and will be left with permanent disabilities of some sort. Would he have grown a set and voted with the dems on this, or would he have caved and voted with the rest of the repugs? I have to wonder if he considers this a slap in the face like Dole must? We'll never know, but he was the one 'not voting.'
