While members of the public have a right to wear a mask when they protest, law enforcement officials should not wear a mask when they arrest protesters and others. An elementary principle of police accountability is to require uniformed officers to identify themselves to the public; this discourages officer misconduct, and facilitates accountability if an officer violates the law. This is one reason EFF has long supported the First Amendment right to record on-duty police, including ICE officers.
For these reasons, EFF believes it is wrong for state legislatures, and now federal law enforcement, to try to criminalize or punish mask wearing at protests. It is especially wrong, in moments like the present, where government it taking extreme measures to crack down on the civil liberties of protesters.

The FBI arrested a California man early Thursday morning for allegedly handing out police-style face masks to a crowd of Los Angeles protesters earlier in the week.
Alejandro Theodoro Orellana is accused of conspiracy to commit civil disorder, U.S. Attorney Bill Essayli announced on X.
“We are moving quickly to identify and arrest those involved in organizing and/or supporting civil disorder in Los Angeles.” Essayli wrote.

Essayli resigns from Assembly to take position

Assemblyman Bill Essayli (R-Corona) was appointed by President Donald Trump to be the new U.S. Attorney for the Los Angeles-based Central District of California on Tuesday, with Essayli accepting the position and resigning from the Assembly.
In a statement on X on Tuesday, Essayli accepted the position, promising to follow Trump’s lead as the U.S. Attorney for the Central District of California.
