Donald Trump has new marching orders from a federal judge: Call off the troops.

“What makes America great is our Constitution,” U.S. District Judge Charles Breyer remarked during a hearing in which he repeatedly compared Trump’s actions to that of a monarch.

After the hearing concluded, Judge Breyer released a written order that surprised few court-watchers.

“At this early stage of the proceedings, the Court must determine whether the President followed the congressionally mandated procedure for his actions. He did not,” Breyer wrote. “His actions were illegal—both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution. He must therefore return control of the California National Guard to the Governor of the State of California forthwith.”

The judge paused his order from taking effect until noon on Friday.
“We live in response to a monarchy”

On June 9, California and Gov. Gavin Newsom (D) filed a federal lawsuit over Trump’s militarized response to Los Angeles protests over the White House’s immigration agenda.

Ignoring the governor’s objections, Trump seized control of 4,000 members of the California National Guard and deployed them along with 700 active-duty Marines to downtown Los Angeles. Newsom said that California could not wait any longer for the judiciary to call off Trump’s illegal and unconstitutional actions.

I have no idea what they'll do. Use it as another opportunity to make an unsupported decision to hand autocratic control to the 47 regime and tear another freedom from us on the "shadow docket"? Or will they say this is a bridge too far?

I suspect we will learn the answer tomorrow.

Or perhaps they'll pull some manoeuver to keep the troops on the ground through the weekend pending decision "real soon now."

They appealed to the 9th and caught a three judge panel made up of two 45 and one Biden appointee. The panel stayed Judge Breyer's order to June 17, when they will hold a hearing. That will be with a randomly selected panel of 11 with the Chief Judge of the Circuit presiding.

FWIW, the entire circuit is 29 members:
10 appointed by Trump
3 appointed by GWB
The rest Clinton, Obama, or Biden

So the odds of sanity ruling at this level is somewhat better than 50% 50%.

But the damage done by leaving the guard under orders of the 47 regime for another five days is enormous.

I'm pretty sure the regime would be toast at the 9th, and they know it.

The 9th has 29 judges
10 appointed by Trump
3 appointed by GWB
The rest Clinton, Obama, or Biden

They'll take another shot at SCOTUS handing them autocratic power in an unsupported decision on the shadow docket.

Or at a minimum, the black robbed traitors on the court can probably be counted on to pull some manoeuver to keep regime-ordered troops on the ground through the weekend as they "deliberate."

But who knows? Perhaps this will be a bridge too far for the likes of Roberts and Coney Barrett.

The three judge panel they caught included two 45 and one Biden appointee, which provides a bit of an explanation for the asshole ruling. (They stayed Judge Breyer's order to June 17.)

They love to criss-cross my driveway all day, at high speed, so I check out whatever wild flowers are blooming.
