From my notesânot a transcript, which doesn't exist yetâthis was the exchange between Judge Nachmanoff & AUSA Lemons about the deputy AG telling him not to reveal if there was a declination memo in the Comey case. (A memo on why prosecutors weren't bringing charges.)

(31,489 posts)1. The next statements from the judge should be
"I am dismissing the charges today with prejudice. And I am holding the DOJ in contempt. You, as counsel of record Mr. Lemon, are hear by ordered to jail until the DOJ produces the declination memo. Deputies... please detain this person."
Could be overkill, but a message needs to be sent that this nonsense needs to stop.
This issue with this exchange is that other prosecutors declined to even pursue a criminal case:
Nachmanoff also pressed prosecutors about whether career officials had initially recommended against prosecuting Comey only to be told by Lemons that the answer could be "privileged."
Something the Grand Jury should have seen and which should now be in the hands of the defense ( IMHO ).

should be referred to their respective bar associations for appropriate disciplinary action.
