Since no criminal charges were brought, Homan was not convicted of bribery or any other crime, and thus was not ordered by a court to return the money as part of any sentencing or restitution. Public corruption experts have noted that while the Justice Department has options for recovering money used in a sting, it is unclear if that will happen in this case, and one headline explicitly stated, "He May Not Have to Return It".
