The @barelyinfo guy who's earlier video breaking down videos of Ms. Good's murder has posted an update, worth watching

His earlier vid has been posted numerous times and gotten a fair bit of attention here, so people may be interested in the updated version. Though early on it has a segment of content from the first video, rest assured that changes after a minute or so, to include the new facts.

It turns out that, yes, it appears that the vehicle did make contact with Ross. HOWEVER, it also shows that Ross LEANS INTO the car in order to cause that to happen. It also mentions a) what the regulations are about shooting into vehicles (e.g. don't), and b) the 2014 report that's been posted about here on DU that showed that ICE have been habitually putting themselves into the paths of vehicles to justify the use of deadly force going back at least 11 years. These facts help with putting his actions into context.

It also shows that very shortly before he steps in front of her car, he switches his cell phone (with which he was recording) from his right (trigger) hand to his left. Maybe not intentional, but suspicious especially given the way he also leans into the path of the vehicle.

But that "newly discovered" video was the one available on the day of the incident. I wonder how widely his original analysis will circulate, as opposed to his corrected version.

As I said days ago - there was contact in the waist/lower torso. His foot slid back on the ice, and he quickly regained his balance - that shows how minimal the hit was.

Still absolutely no excuse for shooting. He asked to be hit by walking in front of a car which was clearly in gear. He was leaning over it with a weapon drawn. The driver was not being confrontational, nor was she threatening him - she was (as directed initially, before being told to get out of the car) leaving the scene.

"Newly discovered" was my word choice, perhaps not accurate, my bad. It's his new analysis of better quality video.

To add to your points at the end, there's also the fact that regulations say they're to move out of the way if possible, but the time window necessary for taking the proper action was instead used up by his action of drawing the weapon, squaring up and firing. He EASILY could've completely gotten out of the way had he not decided that shooting her was preferable. So to me it looks like he took action towards that instead of taking the half-step needed to ensure he was not (lightly) struck by the slow-moving vehicle.

And although the contact could be argued (not convincingly to me) to have justified the first shot, there's NO WAY it justifies shots 2 and 3, which are CLEARLY retaliatory rather than self-defense as he was unquestionably completely away from the path of the vehicle

(Although I believe he used a similar word choice to describe the second video.) And thanks for the addition in the post, for people who don't watch the video, of the rules that ICE is supposed to be following - rather than shooting - but didn't.

Personally, I don't think the shooting was justified at all. But it does make it more complex legally. Part of my arguments against self-defense would be (1) if he had time to casually shift the cell phone to his left hand, rather than just dropping it, he was concentrating on documenting - not saving his life (or anyone else's) - it's illegal in many states to drive with a cell phone in hand - I'd think it was even more important to avoid using a cell phone while pointing a loaded gun (2) he put himself at risk by walking in front of a moving vehicle - it was moving backwards, but it takes a fraction of a second to change directions and (3) a driverless moving vehicle is way more dangerous than one with a driver - even if it had been pointing at him, rather than angling way. By shooting the driver of a car he was creating an even more significant risk to both himself and the public than the driver posed.

with his phone. It was one of the first things that jumped out at me when I watched it the first time. But this is the first time I’ve heard anyone else mention it. I suspect he did it to move his right hand to his holster while Becca was filming him to intimidate her. I don’t really want to watch Renee’s execution again, but it would shed a lot of light on his body language and expressions. I hope they have been able to get the footage to Ellison’s office as part of their investigation.

Edited to add: I posted the above paragraph before watching the video. So interesting that this guy arrived at the conclusion by comparing two different videos at two different times, and I knew it instinctively by watching Ross’s video. What a vile human, a coward, who fled his own crime scene. “Law enforcement” my ass. He’s a state sanctioned murderer.
