Thune is still saying he's bundling the DHS bill in with several other funding priorities, making it more challenging for the senators who already folded to maintain their resistance. It's unclear if enough would hold together if they got some (dubious) promises to reform ICE.
I think they can get those votes IF they agree to changes in the DHS policy like you describe, including things like cooperation with state investigations, unmasking, warrants, chemical gas ban, border patrol back to the border and the like.
I can envision negotiations on those behind the scenes... the political pressure is on republicans right now and I think the Trump WH is spooked for some reason, so we may have leverage to get those changes.
Getting it separated from the other funding is more challenging, and might result in those Dem senators who voted for a 2 month reprieve over the holidays folding. But maybe they're feeling the momentum and can be convinced to hold their shit for now and hold out for more.
Remember (FYI), the WH can find money for DHS by dipping into the general funding of the BBB, and presently, any shutdown won't include DHS agents. They'll keep operating like the last time.
