Don Lemon seeks to unseal the Grand Jury transcripts

I love reading these filings. Even as a non attorney I feel the filings help one understand the issues and arguments.

I think it’s an almost certainty the transcripts get released and the charges get dismissed. Ironically, the protections inserted in the FACE ACT (probably to protect right wingers) will probably protect Lemon and Georgia Fort - as a matter of law.

Basically the argument is the government is not entitled to any regularity or secrecy oconsidering the way they’ve conducted themselves in this case and other cases like Leticia James and James Comey. And there is a strong likelihood the government misstated the law or the journalists’ role in the incident.

Grand jury proceedings are presumed regular and, with some exceptions, ordinarily
protected from outside scrutiny. But the government has squandered that presumption
here. Its conduct has been highly unusual, nakedly political, and inconsistent with practice
in this District. Multiple judges considered the government's "evidence" against Don Lemon and Georgia Fort and declined charges. Undeterred, the government took the prosecution President Trump demanded to a grand jury and obtained an indictment. These circumstances never before seen in this District, and for good reason-raise serious concerns about the government's presentation to the grand jury. To date, everything in this case has been irregular; we can assume the grand jury proceedings were too.

. Attached to this order is an appendix that identifies 96 court orders that
ICE has violated in 74 cases. The extent of ICE's noncompliance is almost certainly substantially understated. This list is confined to orders issued since January 1, 2026, and the list was hurriedly compiled by extraordinarily busy judges. ... This list should give pause to anyone ... who cares about the rule of law. ICE has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence. ... ICE is not a law unto itself.

There are other astonishing examples of the Administration making or presenting false statements and information in this and other proceedings that should deeply trouble the Court and demonstrate that this case is anything but "business as usual." Notably, the White House official social media account posted a photograph of Nekima Levy Armstrong that was doctored to change her appearance-to darken the color of her skin and to doctor her face to make it appear as if she was crying. And blather distractions later, and that is pretty much all they do, why would any person or magistrate of conscience ever consider granting them the benefit of a doubt?

Sucking up and criminality is their birthright. Or is that birthmark?
