Per the Federal Vacancies Reform Act, acting DHS Secretary can only be: the first assistant (deputy), another executive PAS officer, or a qualifying senior DHS employee. A sitting Senator like Mullin qualifies for none he's legislative, not executive. Trump announced the full Secretary role effective March 31, so this assumes immediate nomination + Senate confirmation by then. That's ambitious (hearings typically take longer). If Noem departs first without confirmation, the deputy would act.

Oklahoma Republican Sen. Markwayne Mullin has been rebuked online after he appeared on Fox News Monday and mused on the smell of war, despite never having served in the military himself.

Mullin, a member of the Senate Armed Forces Committee, was discussing the U.S.-Israeli airstrikes on Iran when he channelled his inner Lt. Col. Kilgore from Apocalypse Now (1979), who famously relished the smell of napalm in the morning.

War is ugly, the senator declared authoritatively. It smells bad. If anybody has ever been there and been able to smell the war thats happening around you and taste it and fill it in your nostrils and hear it, its something that youll never forget.

And its ugly. And fortunately, you have President [Pete] Hegseth. Sorry, Secretary Hegseth That has got a great relationship with President [Donald] Trump and President Hegseths been there and hes done that.

Despite accidentally elevating the defense secretary to the presidency twice, it was Mullin presuming to speak for U.S. soldiers that sparked uproar.

Defending nor advocating for him at all, I just think he's not the totally heartless monster that the puppy killer is.

The press huddle where called a 'misspoke' shows me that he is willing to accept error to some degree. Not much but something.

Other than that, there is no person who is willing to do the bidding of the orangeanus that is qualified to do any of the jobs they've been appointed to do.

...I just think you might want to wait a bit before making that judgment.

He has exactly the same kind of ignorance that's led to an agency of maga militia doing what they damn well please under the protection of the federal government.

He's done nothing but demagogue immigrants, smear Pretti and Good... I just stopped posting stuff to you about him because a headache develped in my right eye from the stress of thinking about the months and months to come of taking down what this inveterate liar says, and desperately trying to stop and end what he does.

He needs to be opposed 100% by Democrats in the Senate, and of course that doesn't include any hope for the one dependably republican friendly vote we have in the party on important issues.
