Justice Sonia Sotomayor, who asked many questions in defense of the law, appeared taken aback by Scalias insinuation. In the final moments of oral argument, she asked Bert Rein, the lawyer for the challengers, if he agrees.
Do you think think Section 5 was voted for because it was a racial entitlement? she asked. When he ducked the question, she asked it again. He did not endorse Scalias sentiment.

MORE:
There were audible gasps in the Supreme Courts lawyers lounge, where audio of the oral argument is pumped in for members of the Supreme Court bar, when Justice Antonin Scalia offered his assessment of a key provision of the Voting Rights Act. He called it a perpetuation of racial entitlement.

(17,180 posts)I doubt Thomas could function without Scalia around to tell him what to do, how to vote, and when to go to the bathroom. He'd be wandering the halls, sucking his thumb, and searching his robe for his cell phone to call the Kook Brothers to ask their advice.
I believe he (they) could be impeached... but we both know that ain't gonna happen. Dammit.

The Reagan-appointed jurist said lawmakers keep reauthorizing the Voting Rights Act out of fear of political repercussions. In a sarcastic tone, he described it as odd that congressional renewal has passed with growing margins over the years in spite of the fact that racism is widely acknowledged to have become less severe in the covered jurisdictions since 1965.
It amazes me how clueless some are. Apparently, it never dawned on the Good Judge that the reason racism has become "less severe" is because of legislation identical to the one he's whining about. No wonder we keep taking three steps forward and two back on these types of issues in this country. Even the "smart" guys don't have a clue.
And I'm sure that any second, he'll be whining "that harpy Sonia's being mean to me!" any second.
