Occupy Tulsa supporters who were arrested in November on park curfew violations appeared in court Tuesday to reject the city's plea deal and vow to fight on.

The more than 40 people charged with the misdemeanor city ordinance violation already have been arraigned and have pleaded not guilty to the charges. Tuesday's hearing was the first time the group has appeared together in the same court on one docket.

Attorney Oliver Arbogast is representing most of the defendants. He said he planned to file motions related to why the charges should be dropped, citing the group's First Amendment rights to free speech and peaceable assembly.

Arbogast is representing the defendants during the first phases of the case for free because he said he agrees with their messages, including the defense of the First Amendment and condemnation of what they see as the unchecked expanse of corporations. .............(more)

CHAPEL HILL – The Chapel Hill Town Council recently voted to apologize to the News & Observer newspaper in Raleigh and one of its reporters who was arrested and detained by Chapel Hill police while covering a story in November. In a resolution introduced by town council member Laurin Easthom at the council meeting on January 9th, the council voted to extend an apology for the Chapel Hill Police Department’s actions.

News & Observer newspaper reporter Katelyn Ferral was covering the Chapel Hill SWAT team in action on November 13th when they forcibly removed Occupy Chapel Hill protesters who had broken into the old Yates Motor Company building off of Franklin Street. She was interviewing some of the protesters there at the site earlier in the day and was later taking photographs of the police as they entered the building to arrest the protesters.

According to News & Observer reports, although Ferral had not interfered in any way with the police officers and had not broken any laws, she was arrested and detained by police, handcuffed, and forced to remain face down on the pavement, along with another reporter.

In addition, it has been alleged that Ferral was initially allowed to take photographs, but then was told not to take photographs by police shortly before being detained. ..............(more)

(Reuters) - Prosecutors have subpoenaed the Twitter records of an Occupy Wall Street protester who was arrested in October during a mass protest on the Brooklyn Bridge.

The January 26 subpoena from the Manhattan District Attorney's Office seeks "user information, including email address," along with three months' worth of tweets from @destructuremal, the Twitter handle for Malcolm Harris.

Harris, 23, a freelance writer and editor who lives in the New York borough of Brooklyn, said Tuesday that Twitter sent a copy of the subpoena to him on Monday. He posted it -- where else? -- on Twitter.

"When you get an email from Twitter Legal, you assume it's a phishing scam, trying to get your password," he said. "It turned out that it is a phishing scam, but it's from the prosecutors." .................(more)

In the Middle of Negotiating New Agreement, City Raids Occupy Buffalo

The city had police move on Occupy Buffalo early in the morning after it decided not to renew the occupation’s permit for Niagara Square. At least ten were arrested and tents and personal property were bulldozed. Occupiers had been offered an agreement which they turned down. After midnight, they were in Niagara Square without a permit but the city could have continued to negotiate with Occupy Buffalo and chose to carry out an eviction instead.

The action began to unfold around 1:30 am ET. Police surrounded the square.

A broadcast from @BootsofSolidarity on UStream shows a Buffalo police chief asking who was in the “leadership” at Occupy Buffalo.” The occupiers said, “We have a lot of shared leadership.”

“I need a leader. Or someone you want as a leader that you’ll take direction from,” the chief replied. .............(more)

There are many reasons students have obediently followed and accepted the machine...Occupy has quite dramatically pulled the curtain back and the fires of change are burning brighter now than any time that I can remember.
