And then Trump pulls out a pardon to himself that he had kept from the public, and the Supreme Court upholds it? He would essentially get away scot free, despite Mitchs claim that the criminal courts can handle Trump. I certainly hope that is not the case, but I do fear it.

(59 posts)with some of this. Is failure to uphold the presidential oath of office a criminal offense? I doubt it. Not all impeachable offenses are criminal offenses. I thought McConnell even said that though he felt Trump was morally and practically responsible for the Jan. 6th insurrection, that what he did/said probably would not qualify in criminal law as incitement. Unfortunately, I think he is probably correct on this point (unless an investigation digs up more info.) The impeachment trial is not a criminal trial and the standard of proof is different. That said, there's gotta be some stuff that is going to stick on Trump in a criminal trial, but probably not incitement of the insurrection.
