(4,253 posts)The company is responsible and should have carried insurance to cover these accidents...and the town , county (district) and state are the next in line to assist.
FEMA is assisting individuals. and 75 percent of the clean up.
A disaster is weather caused or war/terror caused. This is negligence . The company chose to not be inspected and keep up its standards. The state chose to not have regulations for the company to comply with.
The state also does not like Federal government interfering. Remember less /small Federal government is what Texas wants.
The can not have it both ways.
I watched CNN this morning and there was NO mention of the company's responsibility or liability.

(5,504 posts)As to the little remark about Texas
"The state also does not like Federal government interfering. Remember less /small Federal government is what Texas wants. "
Maybe that's why so many people and companies are relocating here.

(103,856 posts)companies who want to be "free of regulations" and who like "low wages & right-to-fire" are going there.. and then there's the no-taxes thing.. Taxes pay for this sort of thing.
States who go off willy-nilly , bragging about their lack of regulation, should reap what they sow.. and perhaps should be setting up disaster funds for situations like this.

(13,390 posts)I saw that on MSNBC can't remember which show. Two republicans were saying the feds should pony up. No one mentioned the responsibility of the company. That should make for a huge class action suite.

(2,252 posts)From the Christian Science Monitor article FEMA denies disaster funds for West, Texas. Is that unusual?:
While the ruling means that residents wont get as much assistance as is typically given to victims of tornadoes, hurricanes, and other natural disasters, it isnt unprecedented. FEMA has turned down that level of assistance for emergencies not stemming from natural disasters before, such as in 2010 when officials denied a request for millions in aid after a gas pipeline explosion in northern California.
Lots of information about the FEMA procedures for disaster assistence is available.
The FEMA disaster declaration for West TX is here Texas Explosion.
What is a Declaration?
Some declarations will provide only individual assistance or only public assistance. Hazard mitigation opportunities are assessed in most situations.

Federal Aid Programs for Emergency Declaration for Texas
The earliest release states:
Following is a summary of key federal disaster aid programs that can be made available as needed and warranted under President Obamas emergency declaration issued for Texas.
FEMA is authorized to provide appropriate assistance for required emergency measures, authorized under Title V of the Stafford Act, to save lives and to protect property and public health and safety, or to lessen or avert the threat of a catastrophe in the designated areas.
Specifically, FEMA is authorized to provide emergency protective measures (Category B), including direct Federal assistance, under the Public Assistance program at 75 percent Federal funding. (Source: FEMA funded, state administered.)
How to Apply for Assistance:
Application procedures for commonwealth, tribal and local governments will be explained at a series of federal/state applicant briefings with locations to be announced in the affected area by officials. Approved projects are paid through the state from funding provided by FEMA and other participating federal agencies.
FEMAs mission is to support our first responders and ensure that as a nation we work together to build, sustain, and improve our capability to prepare for, protect against, respond to, recover from, and mitigate all hazards.
About Public Assistance
Yes, the game of politics is being played with the West disaster. Rick Perry is doing the playing.

(4,253 posts)I agree with you Gov. Perry is playing politics..

(68,868 posts)Also, if Texans are so fucking proud of Rick Perry's Texas Miracle they should be more than willing to pick up the tab for the inevitable death and destruction that result from a lack of government safety functions.

(68,868 posts)I have the privilege of not only having a job, but living in a state where the state policy isn't to let poor people die of malnutrition or preventable disease.
The education officials in my state don't believe Jesus rode a dinosaur.
The officials in my state believe scientists over oil lobbyists.
And, folks in my state value human life over that of money. In my state, if someone snatches your purse or wallet and is running away, it's actually illegal to shoot them in the back. Unlike Texas, where killing an unarmed thief in the process of fleeing is specifically allowed and encouraged by the legislature.
Though, in terms of elected officials, I must admit that the Texas All-Star team of Louie Gohmert, Rick Perry, John Cornyn and Ted Cruz are quite an entertaining bunch. You must be so proud.
