As the House of Representatives gears up for Tuesday’s debate on HR 1797, a bill that would outlaw virtually all abortions 20 weeks post fertilization, Rep. Michael Burgess (R-TX) argued in favor of banning abortions even earlier in pregnancy because, he said, male fetuses that age were already, shall we say, spanking the monkey.

“Watch a sonogram of a 15-week baby, and they have movements that are purposeful,” said Burgess, a former OB/GYN. “They stroke their face. If they’re a male baby, they may have their hand between their legs. If they feel pleasure, why is it so hard to believe that they could feel pain?”

That observation led Burgess to say he had argued for the abortion ban to start at a much earlier stage of gestation, 15 or 16 weeks. (This is less than halfway through a pregnancy.) He appeared to liken Roe v. Wade, the 1973 Supreme Court decision that legalized abortion, to the 1893 Plessy v. Ferguson decision that formally legalized racial segregation, and was not fully reversed until Congress passed the Civil Rights Act of 1964.

The rationale for the Republican bill, which advanced through the House Judiciary last week on a near-total party-line vote, is one scientifically disputed study, touted by Judiciary Committee Chairman Bob Goodlatte (R-VA) in his opening remarks at today’s Rules Committee hearing, that asserts fetuses can feel pain as early as 20 weeks after sperm meets egg.

Burgess grew up in Denton County, the son of a physician, and graduated from the University of North Texas and the University of Texas Medical School in Houston. He trained at Parkland Hospital in Dallas and set up an obstetrics-gynecology practice in Lewisville. After 21 years in practice, Burgess decided to run for Congress, his first bid for elective office.

Still suffering from irregular bleeding and in pain, Jennie saw another doctor, Dr. Michael Burgess, in November 1985. This second physician did not do another pap smear, but did various other tests. He decided that Jennie's condition was normal and prescribed medication.
By December of 1985, Jennie could feel a hardening in her cervix. In spite of that and her continued bleeding, Dr. Michael Burgess decided that nothing further needed to be done for Jennie. In February of 1986, Jennie felt a hard spot in her vagina. Dr. Burgess finally performed a cervical biopsy and diagnosed her as having cancer.
In March 1986, Jennie underwent surgery to remove cancerous tissue and lymph nodes in her pelvic area. In April she was again admitted to the hospital because of bleeding. In May, X-rays showed changes that ultimately revealed that the cancer had metastasized to her lungs. In September 1986, her lung cancer finally diagnosed, Jennie began chemotherapy treatments. She died on October 31, 1986.

Texas Representative Michael Burgess warned in a 2010 New York Times post about the malpractice system that there is no quick fix for the American system: “Defensive medicine is a learned methodology, and one that cannot be unlearned quickly, and I believe this contributes significantly to the reason why costs do not decrease quickly and steeply after medical liability reforms are passed.” But there are a variety of reforms being explored — a majority of states have passed legislation with configurations of tort reform that range from proportional liability to damage caps. But such reforms also lead to disagreement between reform and patient advocates. In Texas, liability caps and requirements that mistakes in emergency room care be shown to be “willful and wanton,” are said to have decreased doctor’s insurance polices by thirty percent; however, some believe the quality of care has suffered as a result. The New York Times quotes a local doctor saying, “What Texans don’t know is that their Legislature has mandated a very low standard of care — almost no care.” And in addition, patients now may have a harder time finding lawyers to take a case with limited financial outcomes.
