DOMA IS UNCONSTITUTIONAL 5-4 !!!! Prop 8 vacated due to lack of standing!!!! Also, 5-4.

Opinion is by Justice Kennedy, joined by the four liberal Justices -- Ginsburg, Breyer, Sotomayor, and Kagan.

"DOMA is unconstitutional as a deprivation of the equal liberty of persons that is protected by the Fifth Amendment.

"DOMA singles out a class of persons deemed by a State entitled ot recognition and protection to enhance their own liberty."

Amy Howe: Bottom of 25-26: The federal statute is invalid, for no legitimate purpose overcomes the purpose and effect to disparage and injure those whom the State, by its marriage laws, sought to protect in personhood and dignity. By seeking to displace this protection and treating those persons as living in marriages less respected than others.

An aside: This is vintage Kennedy.

Amy Howe: More from Roberts: "The Court does not have before it, and the logic of its opinion does not decide, the distinct question whether the States . . . may continue to utilize the traditional definition of marriage."

...............that ALL States with DOMA laws on the books (or, as in my case, written into their State Constitutions) now must void those laws, or is it just California?
