Does anyone have any insight into how this affects couples married in a state where it is legal but living in a state where it is not?
It would seem to open a can of worms to only allow federal benefits if you're living in a state where it is legal, no matter where you got married. After all, what if your job transfers you from Massachusetts to North Carolina?

(111,267 posts)and resulted in the Loving vs. State of Virginia case that struck down anti miscegenation laws in backwards states. Eventually the USSC will have to rule that a marriage that is legally performed in one state will have to be recognized by all states, but we're not there yet. Backwards states will still act as though legally married gay couples are living in sin.

(492 posts)I knew it didn't force a state to recognize an out of state marriage but was still hoping that the federal benefits would be afforded my partner and I.

(37,305 posts)I thought the big deal of DOMA is the state recognition or lack thereof. Is that not up for review?

(3,891 posts)Give it a few years, and the Supreme Court will rule on that too. I'll go on record now saying I believe the court will say that Gay Marriage must be recognized in all states, and then the next lawsuit, must be performed in all states.
